Also, increasing regional co-operations among states and companies and other institutions, are making crimes and their effects transnational, particularly in organized and economic crimes. For this reason, the international society and its various institutions, feeling insecure, have reacted in different ways. An international approach has been taken towards national crimes. National crimes, gradually and in an increasing manner, are becoming international crimes whose control requires international cooperation. In this line of argument, and considering the common approach taken by international community, the subject of combating corruption considered as international responsibility, came into the agenda of the United Nations in 1975 when the General Assembly adopted a resolution on the subject. Finally, the issue of adoption of an independent binding convention against corruption was raised in 2000 in the GA Resolution 55.61. As the first steps, an expert committee and a secretariat and office of crime prevention and control of narcotic drugs, were established at the UN Organization which in turn led to the adoption in 31 October 2003 by the UN of the Convention against Corruption (Merida). The Convention was signed by the Islamic Republic of Iran on 10 November, 2003 and in October 2005 a bill on the accession of the country to the Convention submitted to the Iranian Parliament, Majlis. Due to the objections raised by the Guardianship Council, its final ratification was done by the Expediency Council in accordance with Principle 112 of the Constitution on 23 September 2008. Now, taking into account the Iranian membership of the Convention, a comparative analysis of the obligations arising from the Convention with those of the Iranian criminal system, seems necessary. Although there is no fundamental conflict between the Iranian and the Convention provisions and since Iran is obliged to comply with the objectives of the Convention, some amendments to the national laws are required.}, keywords = {convention against corruption,International Criminal Law,Iranian legal system,United Nations}, title_fa = {قلمرو انطباق رویکرد قانونگذار ایران با مقررات متحدالشکل مقابله با فساد در کنوانسیون مریدا}, abstract_fa = {تحت تأثیر پدیدۀ جهانی شدن و آثار و پیامدهای آن، فرصت‌های تازه‌ای برای بزهکاران پدید آمده و اشکال نوینی از بزهکاری ظهور و توسعه یافته است که برای صلح، امنیت، ثبات و توسعۀ پایدار جامعۀ بشری و حاکمیت قانون، تهدید به‌شمار می‌آید. همچنین روند رو به افزایش تعاملات منطقه‌ای میان دولت‌ها و شرکت‌ها و سایر مؤسسات باعث شده آثار رفتارهای مجرمانۀ ارتکابی، به‌خصوص در جرایم سازمان‌یافته و اقتصادی، محدود به کشور «محل وقوع جرم» نباشد، بلکه آثار مخرب آن به سایر کشورها نیز تسری یابد. از این رهگذر جامعۀ جهانی احساس ناامنی کرده است و بدین جهت واکنش مؤسسات و جامعۀ بین‌المللی نسبت به این امر رو به افزایش است. جرایم ملی، ماهیتی بین‌المللی به خود می‌گیرد و به مرور به جرایم بین‌المللی تبدیل و مبارزه با آن صرفاً با همکاری بین‌المللی میسر می‌شود. به همین منظور و با توجه به احساس مشترک و نگرانی‌های جامعۀ جهانی، موضوع مقابله با فساد در سازمان ملل متحد، مسئولیتی بین‌المللی تلقی و به طور رسمی و صریح از سال 1975 با تصویب قطعنامه‌ای در مجمع عمومی آغاز شد. موضوع تصویب کنوانسیونی مستقل برای مبارزه علیه فساد در قطعنامۀ شمارۀ 61/55 مورخ 4 دسامبر 2000 مجمع مطرح شد که نتیجۀ آن تشکیل «کمیتۀ کارشناسی» در دبیرخانۀ دفتر پیشگیری از جرم و کنترل مواد مخدر در سازمان بود که در نهایت به تصویب کنوانسیون مبارزه علیه فساد در قطعنامۀ 4/58 مجمع در تاریخ 31 اکتبر 2003 و در تکمیل کنوانسیون آن سازمان در مورد مبارزه با جرایم سازمان‌یافتۀ فراملی 29 سپتامبر 2003 منجر شد. تصویب نهایی کنوانسیون در تاریخ 2/7/1387 توسط مجمع تشخیص مصلحت نظام در راستای اصل 112 قانون اساسی ج.ا.ا انجام پذیرفت. این مطالعۀ تطبیقی نشان می‌دهد که با توجه به عضویت ایران در کنوانسیون، تعارض اساسی بین اصول نظام حقوقی داخلی و حقوق بین‌الملل مبارزه با فساد وجود ندارد و ایران موظف به تطبیق بیشتر حقوق داخلی با اهداف کنوانسیون در حوزۀ پیشگیری، جرم‌انگاری، مبادلۀ اطلاعات، تعقیب و مجازات و مبارزۀ ضد فساد از طریق همکاری‌های منطقه‌ای و بین‌المللی در بخش‌های خصوصی و دولتی است.    }, keywords_fa = {convention against corruption,International Criminal Law,Iranian legal system,United Nations}, url = {https://jplsq.ut.ac.ir/article_55794.html}, eprint = {https://jplsq.ut.ac.ir/article_55794_253b3c7f45c2313bf7cae9bf9cbd80c5.pdf} }
