Based on this assumption, Under the Constitution the responsibility of defending the oppressed, regardless of their religion, is an obligation upon the government of the Islamic Republic of Iran. However, there appears to be a contradiction between the above-mentioned Rule which requires the government of the Islamic Republic of Iran to assist people's movements in pursuit of justice, and the Principle of Non-Intervention. A principle regarded as one of the most fundamental principles of contemporary International Law and viewed by the State of Islamic Republic of Iran as binding and obligatory. Based on an exploratory study, this article is an attempt to evaluate current theories on the applicability of the mentioned principles.}, keywords = {Foreign Policy,human rights,international rights,Jihad,principle of non-intervention,rule 154 of the constitution of the Islamic Republic of Iran}, title_fa = {ارزیابی قابلیت اجرایی اصل 154 قانون اساسی (ج.ا.ا) در حقوق بین‌الملل معاصر}, abstract_fa = {قانون اساسی جمهوری اسلامی ایران مبتنی بر آموزه‌های اسلامی و ارزش‌های انسانی، رویکرد حمایت از مستضعفان وجنبش‌های آزادی‌خواهانه در جهان در راستای مبارزه با بی‌عدالتی، رابه‌عنوان یکی از سیاست‌های کلی نظام جمهوری اسلامی ایران در عرصۀ بین‌الملل قرار داده است. با این مفروض، قانون اساسی مسئولیت حمایت از مستضعفان و ستمدیدگان جهان، اعم از مسلمان و غیرمسلمان را جزو تعهدات جمهوری اسلامی ایران می‌داند. اما در این خصوص، تعارضی حاکم است؛ از سویی اصل 154 قانون اساسی از تعهد جمهوری اسلامی ایران به ‌حمایت از مبارزات حق‌طلبانۀ‌ مستضعفان در برابر مستکبران در هر نقطۀ عالَم سخن می‌گوید.از سوی دیگر، اصل عدم مداخله در امور داخلی دولت‌ها از جمله اصول بنیادین حقوق بین‌الملل معاصر است که دولت جمهوری اسلامی خود را متعهد بدان می‌داند. در مقالۀ حاضر با مختار دانستن فرضیۀ امکان تطبیق این دو اصل فرضیه‌های رایج در این خصوص ارزیابی شده است.}, keywords_fa = {اصل عدم مداخله,اصل 154 قانون اساسی جمهوری اسلامی ایران,جهاد,سیاست خارجی,حقوق بین‌الملل,حقوق بشر}, url = {https://jplsq.ut.ac.ir/article_57466.html}, eprint = {https://jplsq.ut.ac.ir/article_57466_f8c71d3a9fbaf44b4cd9786efbd42585.pdf} }
