During the years of ongoing armed conflict between ISIS and the States of Syria and Iraq, in addition to invading parts of the territories of the two states, the mentioned group has also seized a number of oil and gas fields as well as related infrastructures. As a result, ISIS stands to gain benefits by selling crude oil which is one of the most important sources of its revenue. Israel has also exploited the marine oil and gas resources unilaterally by occupying Palestine since 1995. The issue of occupation is subject to International Law of Belligerent Occupation. As a legal situation, belligerent occupation is followed by legal effects which will in turn raise new issues in the field of Occupation. Hence, whether the occupant has the right to seize and use oil and gas reservoirs and infrastructures and if so, to what extent the rules and regulations of the Law of Belligerent Occupation protect the oil and gas reservoirs and infrastructures as governmental properties, are some of the consequential questions in need of an answer. In this study, the rules of The 1907 Hague Convention and the fourth Geneva Convention of 1949- both in association with properties- are considered to determine the situation of oil and gas reservoirs and infrastructures in the Occupied State and also to provide a commentary on the efficiency and usefulness of these rules and regulations. }, keywords = {Belligerent occupation,International Law,oil and gas,oil reservoirs and infrastructures}, title_fa = {تصرف منابع فسیلی از منظر حقوق بین‌الملل بشردوستانه}, abstract_fa = {اشغال کشورها در طول تاریخ ملل متحد، بدون مجوز شورای امنیت، به‌عنوان متولی تجویز توسل به زور، تاکنون چندین بار صورت گرفته است. گروه تروریستی داعش، در طول چند سال مخاصمۀ مسلحانه با دولت سوریه و عراق، صرف نظر از اشغال برخی از قلمرو این دو کشور، برخی از تأسیسات و میادین نفت و گاز را تصرف و اقدام به فروش نفت خام و کسب درآمد از این محل کرده است که یکی از مهم‌ترین منابع درآمد داعش به‌شمار می‌رود. اسرائیل نیز با اشغال فلسطین، منابع دریایی نفت و گاز این کشور در غزه را از سال 1995 به بعد مورد تصرف و بهره‌برداری یکجانبه قرار داده است. موضوع اشغال تابع نظام حقوق بین‌الملل اشغال نظامی است و پس از اشغال، آثار حقوقی چندی به‌بار می‌آید که موجب طرح مسائل جدیدی می‌شود. آیا اشغالگران حق تصرف و استفاده از ذخایر و تأسیسات نفت و گاز را دارند؟ تا چه حد قوانین و مقررات حقوق اشغال نظامی، از ذخایر و تأسیسات نفت و گاز که در زمرۀ اموال غیرمنقول دولتی محسوب می‌‌شوند محافظت به‌عمل می‌آورد؟ در این پژوهش مقررات لاهه 1907 و نیز کنوانسیون چهارم ژنو 1949 که در ارتباط با اموال هستند، بررسی می‌شوند تا بتوان از این طریق وضعیت ذخایر و تأسیسات نفت و گاز در کشور اشغال‌شده را مشخص کرد و به کارایی این قوانین و مقررات نظر داد.  }, keywords_fa = {Belligerent occupation,International Law,oil and gas,oil reservoirs and infrastructures}, url = {https://jplsq.ut.ac.ir/article_59472.html}, eprint = {https://jplsq.ut.ac.ir/article_59472_f756b7526937ad3600e67e669a8b0816.pdf} }
