Fundamental changes toward hermeneutical have prevented from a creation of comprehensive definition for hermeneutics. Basically, approaches toward hermeneutics is a threefold: specific, general and philosophical. The classic or general hermeneutics presumes a fixed meaning for the text and tries to find out the intention of the writer. However, in the philosophical hermeneutics, the text does not necessarily refer to a fixed meaning. This is due to the unlimited real meanings of one text, none of which has priority over the others. The classic hermeneutics has a close relationship with the topic of Terms (Alfaaz) in the principles of Islamic Jurisprudence (Figh’). On the other hand, the theoretical foundations of the philosophical hermeneutics are mostly inconsistent with the opinions of the Islamic scholars. Hermeneutics is the science of understanding the texts which are interpretable according to the nature of their subject matter. The laws are also in need of being interpreted in case of their ambiguity, deficiency or silence of the legislator. Hence, interpretation of the legal texts is considered as a branch of hermeneutics named as legal hermeneutics. The Constitution is not­ exceptional; its interpretation is specifically assigned to the Guardian Council. The Guardian Council is a legal authority with legal-jurisprudential tendencies that in its capacity as the interpreter of the Constitution, tries to discover the legislator’s intention through the principles of Shia Jurisprudence. Therefore, only those hermeneutical tendencies that believe in a fixed meaning of the text can be evaluated by the interpretive judgments of the Guardian Council; the philosophical hermeneutics which is based on a changeable understanding of a text cannot be implemented in the Council’s interpretive judgments.}, keywords = {Legal Hermeneutics,Classic Hermeneutics,Philosophical Hermeneutics,the Guardian Council Interpretation,Textual Principles}, title_fa = {بررسی نسبت میان هرمنوتیک حقوقی و آرای تفسیری شورای نگهبان}, abstract_fa = {هرمنوتیک فن فهم و دانش تفسیر است. چرخش‌های بنیادین در جهت‌گیری‌های هرمنوتیکی سبب شده است تا نتوان تعریف جامعی برای آن در نظر گرفت. به طور کلی هرمنوتیک دارای سه رویکرد خاص‌، عام و فلسفی است. هرمنوتیک عام یا کلاسیک برای متن معنای ثابت قائل است و در پی کشف مراد مؤلف است، اما در منظومۀ هرمنوتیک فلسفی، متن لزوماً معنای ثابتی ندارد، زیرا دارای فهم‌های حقیقی نامحدودی است که هیچ‌کدام بر دیگری برتری ندارد. هرمنوتیک کلاسیک ارتباط نزدیکی با مبحث الفاظ در اصول فقه دارد. برعکس، مبانی فکری هرمنوتیک فلسفی با عقاید علمای اسلام دارای تعارضات فراوانی است. هرمنوتیک دانش درک و فهم متونی است که برحسب طبیعت موضوع خود تفسیرپذیرند. قوانین نیز به دلیل ابهام، نقص و سکوت قانون‌گذار به تفسیر نیاز دارند. بنابراین، تفسیر متون حقوقی شاخه‌ای از مباحث هرمنوتیک است که ذیل هرمنوتیک حقوقی از آن بحث می‌شود. قانون اساسی نیز از این امر مستثنا نیست. تفسیر قانون اساسی ذیل اصل 98 کار ویژۀ شورای نگهبان است. شورای نگهبان مرجعی قانونی با گرایش‌های فقهی- حقوقی است که در مقام تفسیر قانون اساسی با استفاده از دانش اصول فقه شیعی در پی کشف ارادۀ قانون‌گذار است. لذا آن دسته از گرایش‌های هرمنوتیکی که به معنای ثابت متن معتقدند قابل ارزیابی با آرای تفسیری شورای نگهبان‌اند، اما هرمنوتیک فلسفی که به فهم قابل تغییر از متن اعتقاد دارد، جایی در نظریات تفسیری شورای نگهبان ندارد.}, keywords_fa = {اصول لفظیه,تفسیر شورای نگهبان,هرمنوتیک حقوقی,هرمنوتیک کلاسیک,هرمنوتیک فلسفی}, url = {https://jplsq.ut.ac.ir/article_63103.html}, eprint = {https://jplsq.ut.ac.ir/article_63103_99ccfa573c5d24932bff3098e68b5994.pdf} }
