Therefore it can be said that democracy is the exact basis and foundation of the principle of rule of law and is a mean for guaranteeing citizen rights by legal instruments. A look at the history of formation of democratic states showa that regulating paying taxes and how and where the taxes are being used, accompanied with pubic satisfaction has been a main factor for moving towards achieving democracy. The reason why Democratic states pay so much attention to taxes is not solely to create a supervisory right for citizens or to give them a right to seek answers from the political system but beyond that it is a sign of existence of legal arrangements for making such procedures possible. Democracies in addition to having financial needs to taxes for managing ongoing governmental affairs, due to the welfare obligations that they undertake, they require and very much depend on taxes. The main question of this research is whether tax is considered as a mean for democracy and political development? Studies and researches show that taxation and fully relying on tax incomes is not the only sign of political development and democracy or a sign of a move towards democracy, and that the way of collecting taxes and how the taxes are being used can also be effective in improving democratic indexes. Our research method is analytical-descriptive based on interdisciplinary studies. The data have been collected based on the library method.}, keywords = {ax,Democracy,Political Development,Public Satisfactory,Citizenship rights}, title_fa = {بررسی حقوقی نقش مالیات بر توسعۀ سیاسی و دموکراسی}, abstract_fa = {توسعۀ سیاسی و به دنبال آن دموکراسی از جمله مفاهیمی‌اند که با وجود داشتن زمینۀ سیاسی، پیوند و ارتباط جدی با دانش حقوق دارند. بنابراین، می‌توان گفت پایه و اساس دموکراسی، همان پایه و اساس حکومت قانون با رویکرد ماهوی و تضمین حقوق شهروندی به‌وسیلۀ ابزارهای قانونی است. نگاهی به تاریخ تکوین حکومت‌های دموکراتیک نشان می‌دهد که قانون‌مندشدن أخذ‌‌ مالیات و محل مصرف آن از طریق رضایت عمومی، عامل اصلی در گذار به دموکراسی بوده است. توجه دولت‌های دموکراتیک به مالیات صرفاً ایجادکنندۀ حق نظارت و به پاسخ طلبیدن نظام سیاسی نیست، بلکه فراتر از آن نشانی از وجود ترتیبات قانونی است که چنین روندی را موجب می‌شود. دموکراسی‌ها علاوه بر نیاز مالی به مالیات برای گذران امور جاری حکمرانی، به سبب تعهدات رفاهی که بر عهده می‌گیرند، نیاز بسیاری به مالیات دارند. سؤال اصلی این پژوهش این است که آیا مالیات را می‌توان ابزاری برای تحقق دموکراسی و توسعۀ سیاسی محسوب کرد؟ بررسی‌ها و نتایج این پژوهش نشان داد که صرف اخذ مالیات و اتکای کامل بر درآمدهای مالیاتی، نه‌تنها نشانۀ توسعۀ سیاسی و دموکراتیک‌بودن یا گذار به دموکراسی نیست، بلکه کیفیت دریافت مالیات و شیوۀ مصرف آن می‌تواند در بهبود شاخص‌های دموکراتیک مؤثر واقع شود. روش پژوهش ما از نوع تحلیلی-توصیفی و مبتنی بر مطالعات میان‌رشته‌ای است. داده‌های پژوهش به شیوۀ کتابخانه‌ای جمع‌آوری شده‌اند.}, keywords_fa = {توسعۀ سیاسی,حقوق شهروندی,دموکراسی,رضایت عمومی,مالیات}, url = {https://jplsq.ut.ac.ir/article_63749.html}, eprint = {https://jplsq.ut.ac.ir/article_63749_3212e7599317456a9172e552c9ebd53f.pdf} }
