Human rights today are a new version of the natural law yesterday. Apart from this, more and more influence of principles & opinions of natural law on the body of contemporary international legal system became more obvious manifestation when the traditional system of making rule could no longer meet the requirements and needs of the international community in all areas -specifically the human rights area- so the declaration of "Martens clause" was ratified by the States. Thus we have witnessed new development in the field of construction and modification of the most important sources of international human rights law, which is in response to the needs of the day, and a manifestation of the link between Martens Clause and human rights in the new legal order.}, keywords = {Natural Law,Customary Law,Martens Clause,Sources of International Law}, title_fa = {نسبت میان شرط مارتنس و حقوق بشر در نظم حقوقی بین‌المللی جدید}, abstract_fa = {ساختار و مبانی نظام حقوق بین‌الملل امروز اغلب مبتنی بر آرا و اندیشه‌های مکاتب پوزیتیویستی است و به همین سبب نیز حاکمیت دولت‌ها محور اصلی ساخت قواعد حقوق بین‌الملل تلقی می‌شود، اما نباید از یاد برد که موجودیت و اعتبار حقوق بشری که اکنون به‌کرات از آن سخن می‌گوییم، مدیون ساخت و ارادۀ دولت‌ها نیست. حقوق بشر امروز روایتی تازه از همان حقوق طبیعی دیروز است. علاوه‌بر این، نفوذ بیش از پیش اصول و مبانی حقوق طبیعی بر پیکرۀ نظام حقوق بین‌الملل معاصر آن هنگام تجلی بارزتری یافت که نظام سنتی قاعده‌سازی موجود دیگر نمی‌توانست در تمام زمینه‌ها – به‌طور مشخص حوزۀ حقوق بشر - پاسخگوی اقتضائات و ضرورت‌های جامعۀ بین‌المللی باشد. ازاین‌رو اعلامیۀ «شرط مارتنس» به تصویب دولت‌ها رسید. بدین‌ترتیب در حال حاضر شاهد تحولی نوین در عرصۀ ساخت و پرداخت مهم‌ترین منابع حقوق بین‌الملل بشریم؛ تحولی در راستای پاسخ به نیازهای روز؛ تحولی که تجلی پیوند شرط مارتنس با حقوق بشر در نظم حقوقی جدید است.}, keywords_fa = {Natural Law,Customary Law,Martens Clause,Sources of International Law}, url = {https://jplsq.ut.ac.ir/article_67097.html}, eprint = {https://jplsq.ut.ac.ir/article_67097_1686174a88ea8f9df10d0e6b62418d90.pdf} }
