For this reason, the distributive and interactive nature of cyberspace together with low costs of accountability has increased the effective function of attacks in the cyberspace. Moreover, anonymity in this space has facilitated rapid operations in a wide geography which in turn leads to attacks, destructions and crimes in this environment. These cause violation of territorial integrity and national security of States. In absence of effective rules and provisions has left the issue of international responsibility for these crimes and their legal prosecution in a vague situation. This article deals first with the definition of cyberspace and emphasizes upon the fact that though in circumstances as stand now, resort to cyber-attacks is considered as use of force in international law, nevertheless identification of their legal area faces many obstacles in different circumstances including in the law of war, resort to force and self-defense making the entering into this issue of international law difficult.}, keywords = {Use of Force,Cyber Attacks,International Law,Self-Defense,United Nations Charter}, title_fa = {جنگ سایبری و توسعۀ حقوق بین‌الملل منع توسل به زور}, abstract_fa = {استفاده از فضای سایبری برای دستیابی سریع و مؤثر به اهداف راهبردی، امروزه به ابزار جدید جنگی و مهم برای همۀ بازیگران دولتی و غیردولتی تبدیل شده است. به همین سبب، ماهیت توزیعی و تعاملیِ فضای سایبری، به‌همراه هزینۀ پایین ابزارهای پاسخگویی، عملکرد مؤثر و حملۀ در فضای مجازی را افزایش داده است. به‌علاوه، گمنامی در این فضا، هماهنگی عملیاتیِ سریعی را در محدودۀ جغرافیاییِ وسیعی تسهیل کرده و به وقوع حمله، تخریب و جرائمی در این فضا منجر شده که امنیت ملی و تمامیت ارضی کشورها را نقض کرده و در غیاب قواعد و قوانین حقوقیِ کارامد، مسئولیت بین‌المللیِ این جرائم و پیگیری حقوقیِ این حملات را در هاله‌ای از ابهام قرار داده است. ازاین‌رو مقالۀ حاضر با بررسی و تفاسیر تعاریف حملات سایبری و همچنین شبیه‌سازی این رویداد، بر این موضوع تأکید می‌کند که اگرچه در شرایط کنونی استفاده از حملات سایبری به‌مثابۀ توسل به زور در حقوق بین‌الملل مورد بحث و گمانه‌زنی است، لکن شناساییِ قلمرو حقوقیِ آن نیز با موانعی در شرایط مختلف و از جمله حقوق جنگ، توسل به‌ زور و حق دفاع مشروع روبه‌روست که ورود حقوق بین‌الملل به بحث را با چالش مواجه کرده است.}, keywords_fa = {Use of Force,Cyber Attacks,International Law,Self-Defense,United Nations Charter}, url = {https://jplsq.ut.ac.ir/article_67645.html}, eprint = {https://jplsq.ut.ac.ir/article_67645_ec58e7f8773f65121cdbf56ae404c414.pdf} }
