In the course of the proceedings of the Court, the United States, in addition to proposing multiple objections to the conditions of issuing the interim order (prima facie jurisdiction, the plausibility of the claimed rights and its relation to the interim order, the urgency and irreparable prejudice), argued that the requested interim order will violate the USA's sovereignty. The Court, in its conclusions, which often was as a result of the acceptance of the arguments of the Iranian legal team, affirmed the necessary conditions for the issuance of an interim order. According to The Court, the criterion of irreparable prejudices is not merely financial damage, but damage to human lives.}, keywords = {United States of America,Islamic Republic of Iran,International Court of Justice,Interim Order,Treaty of Amity,Humanitarian Needs}, title_fa = {ارزیابی ایرادهای آمریکا در مورد دستور موقت در قضیۀ نقض‌های ادعایی عهدنامۀ مودت}, abstract_fa = {دیوان بین‌المللی دادگستری در یازدهم مهر ۱۳۹۷ (3 اکتبر ۲۰۱۸) به درخواست ایران برای صدور دستور موقت در قضیۀ نقض‌های ادعایی عهدنامۀ مودت به اتفاق آرا پاسخ مثبت داد و آمریکا را ملزم کرد تا تمهیدات لازم را در مورد صادرات آزاد به ایران در خصوص نیازهای انسان‌دوستانه از جمله دارو و لوازم پزشکی و بهداشتی، محصولات کشاورزی و غذایی و قطعات یدکی و تجهیزات ضروری و خدمات برای ایمنی هواپیمایی کشوری اتخاذ کند و هیچ‌گونه محدودیتی در مسیر پرداخت‌ها و انتقال وجوه مربوط به این اقدام‌ها ایجاد نکند. در جریان رسیدگی دیوان به درخواست ایران، آمریکا علاوه‌بر طرح ایرادهای متعدد در زمینۀ شروط صدور دستور موقت (صلاحیت علی‌الظاهر، باورپذیری حقوق مورد‌ادعا و ارتباط آن با دستور موقت درخواست‌شده، شرط فوریت و جبران‌ناپذیربودن خسارت)، استدلال می‌کرد که دستور موقت درخواست‌شده به نقض حقوق حاکمیتی این دولت منجر خواهد شد. دیوان در نتیجه‌گیری‌های خود که اغلب در نتیجۀ پذیرش استدلال‌های تیم حقوقی ایران بوده، شروط لازم برای صدور دستور موقت را احراز کرد. به نظر دیوان، معیار خسارت‌های ‌جبران‌ناپذیر صرفاً خسارت مالی نیست، بلکه صدمه و خسارت به جان انسان‌هاست.}, keywords_fa = {ایالات متحدۀ آمریکا,جمهوری اسلامی ایران,دیوان بین‌المللی دادگستری,دستور موقت,عهدنامۀ مودت,نیازهای انسان‌دوستانه}, url = {https://jplsq.ut.ac.ir/article_72612.html}, eprint = {https://jplsq.ut.ac.ir/article_72612_c1239009de2ce3f37f001a2e40e4e2d1.pdf} }
