This Convention has created a comprehensive and multi-faceted legal framework including the adoption of an interdisciplinary and multidimensional approach toward preventing and combating VAW and has presented a pervasive definition and interpretation of discrimination and its manifestations against women. Adopting an extensive method toward all forms of VAW and their criminalization, and generalizing the scope of Parties' obligations to armed conflicts and migration and asylum status in protecting women against all forms of violence are another features of the Convention. This Convention, through aforementioned characteristics, seeks to prevent, prosecute and eliminate violence against women and girls and domestic violence. Not only does it develop and strengthen the legal regime regarding gender-based violence, the treaty can also be accessible to and acceded by third countries, which are not members of the Council of Europe. The present article aims to investigate the innovations and potential capabilities of Istanbul Convention as regards the reduction and elimination of VAW under an International Law perspective.}, keywords = {International Law,human rights,Violence against Women,Council of Europe,2011 Istanbul Convention}, title_fa = {حمایت از زنان در برابر خشونت در پرتو کنوانسیون 2011 استانبول در خصوص پیشگیری و مبارزه با خشونت علیه زنان}, abstract_fa = {کنوانسیون پیشگیری و مبارزه با خشونت علیه زنان و خشونت خانگی 2011 شورای اروپا (کنوانسیون استانبول)، جدیدترین معاهده‌ای است که مستقیماً به مقولۀ خشونت علیه زنان می‌پردازد. این کنوانسیون، به ایجاد چارچوب جامعِ حقوقی و از جمله اتخاذ رهیافتی میان‌رشته‌ای در پیشگیری و مبارزه با خشونت علیه زنان دست زده و تعریفی فراگیر و تفسیری موسع از تبعیض علیه زنان و مصادیق آن ارائه داده است. همچنین اتخاذ رویکردی جامع در قبال اشکال گوناگون خشونت علیه زنان و جرم‌انگاری آنها و تعمیم و توسعۀ دامنۀ تعهدات دولت‌ها به وضعیت‌های پناهندگی، مهاجرت و مخاصمات مسلحانه برای حمایت از زنان در برابر کلیۀ صوَر خشونت، از دیگر ویژگی‌های این کنوانسیون است. بر این ‌اساس، کنوانسیون استانبول با ویژگی‌های پیش‌گفته در پی پیشگیری، پیگرد و حذف خشونت علیه زنان و دختران و خشونت خانگی است. این سند، نه‌تنها رژیم حقوقیِ خشونت مبتنی بر جنسیت را توسعه می‌بخشد و تقویت می‌کند، بلکه حتی می‌تواند در دسترس و مورد الحاق کشورهای ثالثی که عضو شورای اروپا نیستند نیز، قرار بگیرد. مقالۀ فرارو بر آن است تا از چشم‌انداز حقوق بین‌الملل، به بررسی نوآوری‌ها و توانمندی‌های بالقوۀ کنوانسیون استانبول در کاهش و حذف خشونت علیه زنان مبادرت ورزد.}, keywords_fa = {حقوق بین‌الملل,حقوق بشر,خشونت علیه زنان,شورای اروپا,کنوانسیون 2011 استانبول}, url = {https://jplsq.ut.ac.ir/article_73965.html}, eprint = {https://jplsq.ut.ac.ir/article_73965_9154d65cc60101af4a460101b2d8e37e.pdf} }
