The fundamental documents of space law support this claim. Although spatial technology has progressed greatly, but space law is ambiguous in this regard, and the high cost and potential benefits of space exploration raise the question of whether spatial mighty countries share their discoveries with other countries? The important point is that developing countries are committed to allocating the interests of space exploration for economic development, while industrialized countries are less committed to economic development than developing countries. So these countries have more control over their own space programs, and their programs have more economic value. This article argues that powerful space-based nations have certain legal obligations about sharing the interests of space exploration that are ambiguous in some respects, and developing countries need to fair share of these interests as high as possible. The system of sharing interests only succeeds in helping the interests of the space nations; both developed and non-developed countries.}, keywords = {Exploration,Exploitation,Economic Development,share,Space law,Interest}, title_fa = {اثرگذاری عرف‌های فراملی بر کنوانسیون‌های حمل‌ونقل}, abstract_fa = {عرف و معاهدات بین‌المللی، مکمل یکدیگر در جهت ساخت نظام حقوق حمل‌ونقل بین‌المللی‌اند. عرف‌های فراملی یا ایجادکنندۀ معاهدات یا تکمیل‌کنندة آن‌اند. در این زمینه دو وضعیت رخ خواهد داد؛ یکی وجود عرف و تدوین آن توسط کشورها در قالب معاهده و دیگری وجود معاهده و تکمیل آن از طریق عرف موجود میان تابعان که بعد از معاهده و به‌منظور تسهیل در اجرای آن شکل می‌گیرد. در این مقاله به دستۀ اول پرداخته‌ و به این پرسش پاسخ داده‌ایم که اولاً آیا عرف‌های فراملی موجود در صنعت حمل‌ونقل می‌تواند سبب ایجاد یک معاهدۀ بین‌المللی شود و حقوق بین‌الملل عمومی را به تنظیم مقرراتی در جهت منفعت تابعان منفعل خود وادار کند یا خیر؟ و دوم اینکه در صورت پاسخ مثبت به این پرسش، نحوۀ اثرگذاری این عرف‌ها در ایجاد کنوانسیون‌های حاکم بر حقوق حمل‌ونقل بین‌المللی به چه صورت است؟ نتیجه حاصل‌شده این است که دولت‌ها به‌عنوان تصویب‌کنندگان کنوانسیون‌های حمل‌ونقل بین‌المللی معمولاً تلاش می‌کنند تا منافع متصدیان حمل‌ونقل را هم تأمین کنند. از طرف دیگر، سازمان‌های بین‌المللی دولتی اقدام به جمع‌آوری و تدوین عرف‌های حمل‌ونقلی کرده و با یکنواخت‌سازی عرف‌ها، اجرای قواعد را آسان می‌کنند. اگرچه نظام معاهداتی در ظاهر محکم‌تر از نظام حقوق عرفی است، مزایای عرف موجب شده است تا در برخی موارد به همان شکل گذشته به حیات حقوقی خود ادامه دهد.}, keywords_fa = {اتحادیۀ اروپا,حقوق حمل‌ونقل,دولت‌ها,سازمان ملل,عرف فراملی,کنوانسیون‌های حمل‌ونقل بین‌المللی}, url = {https://jplsq.ut.ac.ir/article_75612.html}, eprint = {https://jplsq.ut.ac.ir/article_75612_eacc44c261a1dbebd60fb59dcb2d66b7.pdf} }
