The International Court of Justice has introduced it as a requirement under general international law in Pulp Mills case and San Juan case pursuant to ITLOS’s explicit recognition of customary status of the EIA. Jurists have different opinions on the EIA, like; the way of becoming a customary rule and especially on the content of it. Based on the descriptive-analytical methodology with the help of library sources, the present article tried to deduce the process of consolidation, customary status and content of this obligation through international judgments/awards and documents and concluded that this customary obligation establishes when there is a risk of significant adverse transboundary impact. If there is such a risk, assessment is done. So, there are three stages; the preliminary assessment measuring the possibility of transboundary harm, conducting the assessment and the post-project assessment that provides valuable information for similar subsequent activities and the validity of assessments.}, keywords = {Transboundary Environmental impact assessment,international environmental law,International Court of Justice,Customary Rule,Espoo Convention}, title_fa = {ارزیابی اثرات زیست‌محیطی فرامرزی در حقوق بین‌الملل}, abstract_fa = {ارزیابی اثرات زیست‌محیطی در سیاق فرامرزی از جمله تعهداتی است که در قلمرو حقوق بین‌الملل محیط‌زیست، در راستای پیشگیری از آلودگی و حفاظت از محیط‌زیست عمل می‌کند و سنجش آثار محتمل یک فعالیت یا پروژة پیشنهادی بر محیط‌زیست کشور/کشورهای دیگر را مقرر می‌دارد. پس از دیوان بین‌المللی حقوق دریاها که به‌صراحت این تعهد را عرفی شناخت، دیوان بین‌المللی دادگستری نیز در قضایای خمیرکاغذ و سان‌خوان، آن را بخشی از حقوق بین‌الملل عام معرفی کرد. نحوة عرفی بودنِ این تعهد مورد اختلاف اندیشمندان حقوقی است، لکن تفاوت نظر عمیق‌تر بر محتوای آن است. در مقالة پیش رو با استفاده از منابع کتابخانه‌ای و با شیوه‌ای توصیفی تحلیلی به سیر قوام‌یافتگی تعهد موصوف، نحوة عرفی شدن و محتوای آن میان آرا و اسناد بین‌المللی پرداخته شده و نشان داده شد که تعهدِ عرفی به ارزیابی اثرات زیست‌محیطی، زمانی ایجاد و آغاز می‌شود که ریسکی با امکان ورود ضرری مهم وجود داشته باشد. اگر چنین ریسکی وجود داشت، ارزیابی صورت می‌گیرد. ازاین‌رو فرایند ارزیابی شامل سه مرحلة ارزیابی اولیه در احتمال ورود ضرر، انجام ارزیابی در صورت تأیید ریسک ضرر فرامرزی و ارزیابی پسینی است که در مرحلة آخر، اطلاعات ارزشمندی برای فعالیت‌های مشابه بعدی و واقعی شدن ارزیابی‌ها مهیا می‌شود.}, keywords_fa = {ارزیابی اثرات زیست‌محیطی فرامرزی,حقوق بین‌الملل محیط‌زیست,دیوان بین‌المللی دادگستری,قاعدة عرفی,کنوانسیون اسپو}, url = {https://jplsq.ut.ac.ir/article_76859.html}, eprint = {https://jplsq.ut.ac.ir/article_76859_f7faed1b51609fdf18fc7a5d7c056a1a.pdf} }
