Although regional mechanisms were delayed to combat the impunity compared to international and national courts and this process is very slow in Asia and America. In fact, regional judicial implementation of international norms is relatively common in the fields of international human rights and there are attempts to create a regional international criminal court, such as the proposed addition of the criminal jurisdiction to the African Court of Justice and Human Rights. But the importance and the necessity of these courts and their relationship to ICC are the new legal challenge. Generally, the case is admissible before the ICC if the State which has jurisdiction is unwilling or unable genuinely to carry out the investigation or prosecution. However, the important issue is: how do regional tribunals fit with the principle of complementarity in Rome Statute? The answer to this question requires the proper understanding of the legal relationship between states and regional tribunals and the contextualized application of the principles of treaty interpretation enshrined in the Vienna Convention.}, keywords = {"Impunity","Regional Mechanisms","International Criminal Court","Complementarity","Interpretation"}, title_fa = {هم‌افزایی دیوان بین‌المللی کیفری و سازوکارهای منطقه‌ای برای مقابله با بی‌کیفری}, abstract_fa = {عدالت کیفری بین‌المللی به‌عنوان یکی از اهداف بنیادین جامعۀ بین‌المللی مطرح است که در سطوح مختلف بین‌المللی، منطقه‌ای و ملی در جهت تحقق آن اهتمام می‌گردد. البته در سطح منطقه‌ای قدری جدیدتر، تحرکاتی برای مقابله با بی‌کیفری دیده می‌شود که این روند درآفریقا در مقایسه با آسیا و آمریکا، با تأسیس دیوان کیفری آفریقایی سرعت بیشتری داشته است. نکتۀ مهم ارزیابی ضرورت و تأثیرگذاری اقدامات منطقه‌ای برای مقابله با بی‌کیفری است و اینکه آیا الگوی سازوکارهای منطقه‌ای در مورد نظارت بر هجارهای حقوق بشری، در اجرای عدالت کیفری بین‌المللی نیز می‌تواند کاربرد داشته باشد یا خیر. همچنین نحوۀ تعامل و ارتباط مراجع قضایی (یا شبه‌قضایی) منطقه‌ای با سایر محاکم کیفری به‌خصوص دیوان بین‌المللی کیفری به‌عنوان یک چالش حقوقی جدی مطرح است، زیرا اصل صلاحیت تکمیلی در اساسنامۀ رم، ناظر بر اعمال صلاحیت دیوان در صورت عدم تمایل یا ناتوانی دادگاه‌های ملی در تعقیب جرائم مشمول صلاحیت دیوان است، حال سؤال کلیدی آن است که آیا این مقرره ناظر بر دادگاه‌های منطقه‌ای نیز است. پاسخ به این مسئله نیازمند درک صحیح از رابطۀ حقوقی میان دولت‌ها و دادگاه‌های منطقه‌ای و اعمال اصول ناظر بر تفسیر معاهدات مندرج در کنوانسیون وین 1969 است.}, keywords_fa = {"Impunity","Regional Mechanisms","International Criminal Court","Complementarity","Interpretation"}, url = {https://jplsq.ut.ac.ir/article_80637.html}, eprint = {https://jplsq.ut.ac.ir/article_80637_77e7473d46c3ace4a6ca178c54a2a5e2.pdf} }
