The Act disregarded the immunity of States committing terrorism in U.S. courts. On 19 January 1984, the U.S. Ministry of Foreign Affairs designated Iran as a State sponsor of terrorism. In 1996, the Anti-Terrorism and Effective Death Penalty Act (AEDPA) was enacted by the U.S. Congress, which in lawsuits against terrorist States provided for financial compensation. As a result of these Acts, numerous lawsuits have been filed by U.S. nationals and in the U.S. courts against Iran. The U.S. courts sentenced Iran to compensation and confiscation of the Central Bank assets instead of State-owned property. The pleading of the Central Bank to the U.S. judicial authorities during the review and appeal proceedings was not successful and the Central Bank assets were confiscated. On 14 June 2016, Iran filed an application against the U.S. in the ICJ, referring to non-observance of State immunity and violation of the 1955 Treaty. The judgment of the Court on jurisdiction was issued on 13 February 2019. The present article examines this judgment in two areas of legal personality of State-owned corporations and immunity of State-owned assets and concludes that the ICJ, according to its inherent obligation, emphasized on the common intention of the parties as the basis of its jurisdiction.}, keywords = {Jurisdictional Objection,Central bank,State Sponsor of Terrorism,Treaty of Amity,Jurisdictional Immunity}, title_fa = {شخصیت ‌حقوقی شرکت ‌دولتی و مصونیت ‌اموال‌ دولتی در پروندۀ «برخی اموال ایران»}, abstract_fa = {ایالات ‌متحدۀ آمریکا در سال 1976 قانون‌ مصونیت‌های‌ حاکمیت‌ خارجی (FSIA) را به تصویب رساند. این قانون مصونیت دولت‌های خارجی مرتکب تروریسم را در دادگاه‌های ایالات‌ متحده نادیده می‌گرفت. از 19ژانویة 1984 جمهوری اسلامی ایران از جانب وزارت ‌امور خارجه ایالات‌ متحده به‌عنوان دولت حامی تروریسم تعیین شد. در سال 1996 قانون‌ مقابله‌ با تروریسم‌ و مجازات‌ مؤثر (AEDPA)، به تصویب کنگرۀ ایالات‌ متحده رسید که در دعاوی مطروحه علیه دولت‌های خارجی مرتکب تروریسم، جبران ‌خسارت ‌مالی را درنظر می‌گرفت. در نتیجة این قوانین، دعاوی متعددی از جانب اتباع ایالات ‌متحده و در دادگاه‌های این دولت، علیه جمهوری اسلامی ایران مطرح شد. دادگاه‌های بخش ایالات ‌متحده، دولت ایران را به جبران خسارت محکوم کرده و حکم به توقیف اموال بانک مرکزی ایران به‌جای اموال دولت می‌کنند. توسل بانک مرکزی به مراجع قضایی ایالات متحده در مراحل تجدیدنظر و فرجام، راه به‌جایی نبرد و اموال بانک مرکزی در ایالات ‌متحده توقیف شد. ایران در 14 ژوئن 2016 با استناد به نادیده گرفته شدن مصونیت دولت و نقض عهدنامۀ مودت 1955، دادخواستی علیه ایالات‌ متحده در دیوان ‌بین‌المللی‌ دادگستری (ICJ) ثبت کرد. رأی صلاحیتی دیوان در ۱۳ فوریة ۲۰۱۹ صادر شد. مقالۀ حاضر به بررسی این رأی در دو حوزۀ شخصیت حقوقی شرکت دولتی و مصونیت اموال دولتی می‌پردازد و به این نتیجه می‌رسد که دیوان در رأی صادره، حسب تکلیف ذاتی خود، ارادۀ مشترک طرفین را مبنای احراز صلاحیت قرار داده و به قدر متیقن اکتفا کرده است.}, keywords_fa = {ایراد صلاحیتی,بانک مرکزی,دولت حامی تروریسم,عهدنامۀ مودت,مصونیت حاکمیتی}, url = {https://jplsq.ut.ac.ir/article_82058.html}, eprint = {https://jplsq.ut.ac.ir/article_82058_f9c13a5a8c340ba469eab3be251b526a.pdf} }
