The fact that committing such an act will impose obligations on the responsible state and create rights for the injured state is well established. However, there is a debate among scholars as to the possibility of succession for the responsible or the injured state in terms of the obligations or rights arising from such an act. Most scholars in this field believe in the traditional doctrine of "negative succession" or "absolute doctrine of non- succession". According to this doctrine, in case the responsible or injured state is succeeded by another state, the resulting rights or obligations prior to the date of succession will not be transferred to the successor state. This article, however, argues that due to the unique features of each type of succession, offering a general solution for the various types of succession is not only illogical, but is also, objectionable in situations such as the consent of the successor state, resort to the principle of unjust enrichment or territorial nature of internationally wrongful act. The doctrine of non-succession needs to be adjusted in view of the realities of international society and in accordance with fundamental principles such as protecting human rights and dignity, justice, equity and prevention of unjust enrichment. A realistic approach which is appropriate for the specific characteristics of different types of succession should be adopted.}, keywords = {State Succession,Negative-succession,doctrine of non-succession,internationally wrongful act,International Responsibility of States}, title_fa = {ناکارامدی دکترین عدم جانشینی در زمینۀ مسئولیت بین‌المللی دولت}, abstract_fa = {مبرهن است که ارتکاب عمل متخلفانة بین‌المللی توسط یک دولت به ایجاد مسئولیت بین‌المللی برای آن دولت منجر می‌شود. این مسئله که به‌تبع ارتکاب چنین عملی، تعهداتی بر دولت مسئول بار خواهد شد و حقوقی برای دولت آسیب‌دیده پدید خواهد آمد، مورد پذیرش حقوقدانان قرار گرفته است. با وجود این اختلاف‌نظرهایی در خصوص امکان یا عدم امکان وقوع جانشینی برای دولت مسئول یا دولت آسیب‌دیده در خصوص تعهدات یا حقوق حاصل‌شده از ارتکاب چنین عملی، بین صاحب‌نظران وجود دارد. در این خصوص اکثر قریب به اتفاق متخصصان این حوزه به دکترین قدیمی «جانشینی منفی» یا «عدم جانشینی مطلق» اعتقاد دارند. براساس این دکترین، در صورت وقوع جانشینی برای دولتی که مرتکب عمل متخلفانۀ بین‌المللی شده است یا دولتی که از ارتکاب چنین عملی آسیب‌ دیده است، حقوق یا تعهداتِ حاصله که پیش از وقوع جانشینی پدید آمده بوده‌اند، به دولت جانشین منتقل نخواهند شد. ازاین‌رو این مقاله در پی بیان این مسئله است که با توجه به ویژگی‌های منحصربه‌فرد هریک از اقسام جانشینی، صدور راه‌حل کلی، واحد و مطلق برای اقسام گوناگون جانشینی نه‌تنها پایه و اساس منطقی ندارد، بلکه با توجه به بروز وضعیت‌هایی مانند رضایت دولت جانشین بر جبران خسارتِ وارده به دولت آسیب‌دیده، توسل به اصل دارا شدن ناعادلانه یا ماهیتِ سرزمینی عمل متخلفانۀ بین‌المللی، این تئوری قابل انتقاد و رد است. با نگاهی بر واقعیت‌های روز جامعة بین‌المللی و با توجه به مبانی اساسی‌ای مانند حفظ حقوق بشر، تأمین عدالت، رعایت انصاف و جلوگیری از دارا شدن ناعادلانه می‌بایست دکترین عدم جانشینی تعدیل شود و رویکردی واقع‌گرایانه و متناسب با ویژگی‌های خاص قسم‌های گوناگون جانشینی اتخاذ شود.}, keywords_fa = {State Succession,Negative-succession,doctrine of non-succession,internationally wrongful act,International Responsibility of States}, url = {https://jplsq.ut.ac.ir/article_82173.html}, eprint = {https://jplsq.ut.ac.ir/article_82173_aedc3aa45fd4906599f4a202f36fcddf.pdf} }
