Article 2 of the latest Egyptian Constitution (approved in 2014) establishes the scope of Islam's role in the domain of governance. This principle, which is based on previous constitutions, provides a minimalist position for observance of Islamic rules and, based on the obstruction of Ijtihad, only recognizes definitive Islamic rules valid as regards conforming of legislation with them. The parliament and the judiciary have no obligation to observe “famous jurisprudents” opinions and are not obliged to follow a particular reading of Islamic law. There is no institution to protect Islamic law and the Council of Elders of Al-Azhar has been removed as the position of al-Azhar has been reduced to a mere academic institution. Due to low voter participation in the constitutional referendum, it can be concluded that contrary to the opinion of the majority of the Egyptian people, the Egyptian Constitution has tended towards secularism.}, keywords = {constitution of egypt,Islam,Al-Azhar,legislative process}, title_fa = {جایگاه اسلام در فرایند قانونگذاری مصر پس از تحولات 2011}, abstract_fa = {از مهم‌ترین چالش‌های پیش روی حکومت کنونی مصر، چالش جایگاه اسلام در ساختار حقوق اساسی آن کشور است. اصل 2 آخرین قانون اساسی مصر (مصوب 2014.م) گسترۀ ورود اسلام به حیطۀ حکمرانی را بیان می‌کند. این اصل که برگرفته از قوانین اساسی سابق است، جایگاه حداقلی را برای رعایت احکام اسلامی در نظر می‌گیرد و بر مبنای انسداد باب اجتهاد، فقط احکام قطعی اسلام را جهت تطبیق قوانین با آنها معتبر می‌داند. پارلمان و قوۀ قضاییه هیچ الزامی برای رعایت نظر مشهور فقها ندارند و ملزم به تبعیت از قرائت خاصی از شریعت نیستند. در زمینۀ نهاد صیانت از احکام اسلامی، هیچ جایگاه قانونی در نظر گرفته نشده و نهاد شورای بزرگان الازهر که در قانون سابق نیز بود، حذف شده است و جایگاه الازهر به نهاد علمی محض تقلیل داده شده است. با توجه به حضور حداقلی مردم در همه‌پرسی قانون اساسی می‌توان برداشت کرد که قانون اساسی مصر برخلاف نظر اکثریت مطلق مردم، به سمت سکولاریسم گرایش یافته است.}, keywords_fa = {اسلام,الأزهر,شورای نگهبان,قانون اساسی مصر}, url = {https://jplsq.ut.ac.ir/article_85434.html}, eprint = {https://jplsq.ut.ac.ir/article_85434_e8737b2cb59d0070306dfd96e968e0f1.pdf} }
