These violations have been committed not only by the Al Khalifa regime as the government of Bahrain, but also by the Saudi regime as a neighbor of Bahrain. Investigating human rights violations of the Shia in Bahrain is very important from the perspective of the law of state responsibility as the basic rights of the Shia including the right to life and personal security and the right to citizenship, have been violated. Indeed, since heartbreaking and tragic acts have been committed in Bahrain, mechanisms under international law are necessary to hold the Bahraini and Saudi regimes accountable. The present paper will scrutinize the law of state responsibility in terms of establishing the international responsibility of the said states. It will be argued that the international responsibility of one state, does not preclude the international responsibility of another one. Each one could be held responsible for its internationally wrongful act and in case of overlapping, joint responsibility will occur.}, keywords = {International Law of Human Rights,internationally wrongful act,International Responsibility,Secondary Obligation}, title_fa = {مسئولیت بین‌المللی بحرین و عربستان سعودی ناشی از نقض حقوق بشر در بحرین}, abstract_fa = {نقض حقوق بشر شیعیان در بحرین که به لحاظ عددی، اکثریت جمعیت بحرین را تشکیل می‌دهند، سال‌هاست که به‌طور نظام‌مند و گسترده، در حال ارتکاب است. این اَعمال نه‌تنها از سوی رژیم آل خلیفه به‌عنوان دولت مستقر در بحرین ارتکاب می‌یابد، بلکه از سوی رژیم آل سعود به‌عنوان کشور همدست و همسایۀ بحرین صورت می‌پذیرد. بررسی نقض حقوق بشر شیعیان در بحرین که حتی حقوق بنیادین آنها از جمله حق حیات و امنیت فردی و حق تابعیت را نشانه رفته است، از منظر حقوق مسئولیت بین‌المللی بسیار حائز اهمیت می‌نماید، زیرا هرچند اَعمال ارتکابی، جانکاه و غم‌انگیز باشد، ولی باید به لحاظ موازین بین‌المللی سازوکاری را یافت تا بتوان مسئولیت بین‌المللی آنها را احراز کرد. پژوهش حاضر با بررسی حقوق مسئولیت بین‌المللی و انطباق ماوقع با ضوابط موجود، به احراز مسئولیت بین‌المللی دولت‌های ذی‌مدخل پرداخته است. در این باره، احراز مسئولیت بین‌المللی یکی، مانع از مسئول دانستن دیگری نیست. هر کدام، مسئول بین‌المللی ناشی از عمل متخلفانۀ بین‌المللی خود قلمداد می‌شود و در مواردی که همپوشانی داشته باشد، مسئولیت تضامنی می‌تواند مطرح شود.}, keywords_fa = {International Law of Human Rights,internationally wrongful act,International Responsibility,Secondary Obligation}, url = {https://jplsq.ut.ac.ir/article_89371.html}, eprint = {https://jplsq.ut.ac.ir/article_89371_98bc47f94c30542e1fc281206c989e08.pdf} }
