Broadly, the ICRC’s main difficulties in these territories can be summarized in three key areas: legal issues related to the military occupation of Palestinian land, the status of East Jerusalem, and the construction of the separation barrier, all of which continue to affect the daily lives of Palestinian civilians. Israel, as the “occupying power,” has effectively disrupted the delicate balance between the “rights” and “obligations” of an occupier by attempting to prioritize its own rights over the humanitarian obligations imposed on it under international law. In this context, the ICRC has sought to move beyond its traditional policy of confidentiality by engaging in open and direct dialogue with both parties, attempting to leverage such engagement to improve the conditions of civilians. کمیتۀ بین ‏المللی صلیب سرخ که در اجرای حقوق بشردوستانۀ بین ‏المللی دارای نقشی اساسی است، در ایفای این وظیفه در سرزمین ‏های اشغالی فلسطین با دشواری ‏های جدی مواجه است. در نگاه کلی می ‏توان سه دشواری اساسی صلیب سرخ در سرزمین‏ های اشغالی را در سه محور عمده خلاصه کرد: مسائل حقوقی مربوط به اشغال نظامی سرزمین فلسطین، وضعیت قدس شرقی و ساخت دیوار حائل که همچنان زندگی شهروندان فلسطینی را تحت تأثیر قرار می‏ دهد. رژیم اسرائیل به ‏عنوان «قدرت اشغالگر» عملاً توازن ظریف میان «حقوق» و «تعهدات» اشغالگر را با تلاش برای برتری دادن حقوق خود بر تعهدات بشردوستانه ‏ای که مطابق حقوق بین ‏الملل بر دوش دارد، برهم زده است. در این شرایط کمیتۀ بین ‏المللی صلیب سرخ با عبور از سیاست سنتی محرمانگی و ایجاد گفت‏وگوی عمومی و صریح با هر دو طرف درگیر تلاش کرده است تا از ظرفیت ‏های چنین گفت‏وگویی برای بهبود وضعیت غیرنظامیان استفاده کند. https://jplsq.ut.ac.ir/article_103451_2c14e6cb2094d1c99f630581774bc508.pdf
