Part of the failure in dealing with Covid-19 was the weakness in implementing these obligations.<strong> </strong>In this research we are going to answer these questions: what is the role of these obligations in the two mentioned fields and what is the sanction in case of violation of them and as a result what are the challenges in their implementation? The most important challenges facing these obligations are the emphasis and desire of states on the two principles of sovereignty and non-interference. This issue is fully illustrated in the Articles on the Protection of Persons in the Event of Disasters (2016) and International Health Regulations (2005). The present paper is based on a descriptive-analytical method. It seems that international cooperation and assistance have an unstable position in the two fields of epidemics and disasters, and the consequence of their violation is only a moral sanction. The solution that can solve these challenges to some extent is to use the capacity of the humanitarian assistance, to approve an international convention in the field of international relief and to seriously revise the international health regulations. تعهدات همکاری و کمک‌رسانی بین‌المللی در دو حوزة بیماری‌های همه‌گیر و بلایا که مشابهت‌های بسیاری دارند، اهمیت مضاعفی دارد. بخشی از ناکامی در مواجهه با کووید-19، ضعف در اجرای همین تعهدات بود. پرسش این تحقیق این است که این تعهدات در دو حوزۀ مذکور چه جایگاهی دارند و در صورت تخلف از آنها چه ضمانت اجرایی وجود دارد و در نتیجه چه چالش‌هایی در اجرای آنها وجود دارد؟ مهم‌ترین چالش‌های پیشِ روی این تعهدات، تأکید و تمایل شدید دولت‌ها به دو اصلِ حاکمیت و عدم مداخله است. این مسئله در مواد مربوط به حمایت از افراد در زمان بلایا (2016) و مقررات بین‌المللی سلامت (2005) نیز کاملاً نمودار است. برای انجام این تحقیق از روش توصیفی-تحلیلی استفاده شده است. به‌نظر می‌رسد همکاری و کمک‌رسانی بین‌المللی، جایگاه متزلزلی در دو حیطۀ همه‌گیری‌ها و بلایا دارند و پیامد نقض آنها صرفاً ضمانت اجرایی اخلاقی است. راهکاری که می‌تواند این چالش‌ها را تا حدی مرتفع کند، استفاده از ظرفیت نهادِ کمک‌های بشردوستانه، تصویب کنوانسیونی بین‌المللی در حیطة نظامِ امدادرسانی بین‌المللی و بازنگری جدی مقررات بین‌المللی سلامت است. https://jplsq.ut.ac.ir/article_104174_ce786ff013723e3d3fca0b3b74d668e8.pdf
