		<Abstract>Petition to vote of confidence to council of ministers in important and disputable promlems and the request to vote of confidence in the case of cabinet reshuffle during the tenure of the government are mentioned in the second section of the 87 and 136 Articles of the Constitution. Both aforementioned instances are effective in the case of the being of prime minister as a guarantee for united government in the political system. After omission of the institution of prime minister in constitutional amendment enacted in 1368, the oversight of Islamic Consultative assembly on the council of ministers by vote of confidence has become nonsense and baseless. Although it has not leaded to practical challenges, theoretically it makes the mess and mutability in the text of the constitution. The Constitutional desuetude explains the situation very well. two elements of constitutional desuetude, ie, “sustained and conscious disuse” as and “being inoperative and invalid” by political actors would be evaluated in the analysis of vote of confidence to council of ministers in both aforementioned Articles.</Abstract>
