However, since peaceful turnouts may be a causative factor for public disturbance and are usually used as an instrument to protest against State’s policies, governments do not seem pleased when a demonstration plans on taking place in public. In order to recognize and secure the right to assembly, the externat to which people can enjoy this right and the circumstances in which governments are allowed to interfere with an assembly should be clarified. Even though international efforts to define the aforementioned right initiated years before Human Rights Council took any steps, the common understanding of what the right to freedom of assembly really is have greatly improved after its involvement and the spotlight on events in a number of Arab countries since 2011. اعلامیۀ جهانی حقوق بشر و میثاق حقوق مدنی و سیاسی، بر وجود حق بر تجمع مسالمت‌آمیز برای شهروندان فارغ از مکان تجمع و محتوای آن صحه گذاشته است. با این همه، تجمع به هنگامی‌که در عرصۀ عمومی برپا می‌شود و شکل تظاهرات به خود می‌گیرد، ممکن است چندان مطلوب دولت‌ها نباشد. چراکه با احتمال بروز اختلال در روند عادی امور، ممکن است برای دیگر شهروندان ایجاد مشکل کند؛ ضمن آنکه تجمع مسالمت‌آمیز ابزاری است برای اعتراض به سیاست‌های دولت. ازاین‌رو، روشن شدنمبانی حق شهروندان در برگزاری تجمع و همچنین بررسی امکان اِعمال محدودیت بر این حقدر وضعیت‌های خاص، به شناساندن و ایفایبهتر تعهدات بین‌المللی در این زمینه کمک می‌کند. تلاش جهانی برای تبیین این حق اگرچه به سال‌ها پیش از اقدام شورای حقوق بشر برمی‌گردد، درک مشترک از حق آزادی تجمع شهروندان پس از توجه شورا به این وضعیت‌ها بیشتر شده است. https://jplsq.ut.ac.ir/article_58192_bdbf166316f1d87610a36b42f2acee35.pdf
