This is one of the most important reasons behind the exclusion of exemptions in computational law. As a result, the legal system governing the mentioned exemptions, is complex and perpendicular to secondary logic. The main issue in understanding the legal system in command of the Budget of War, is to discover those principles and sources that govern the topic. This research is an attempt of legal approach to the related rules and regulations in order to analyze the Budget of War with a focus on the Iran-Iraq war. In addition to raising a new issue in the Public Finance Law, Results of this study seek to express the necessary needs, principles and guidelines in order to reform the Legal System of war budget. جنگ، بخش مهمی از تاریخ بشر را تشکیل می‌دهد. چنین وضعیتیاز مهم‌ترین علل موجد اعتبارات خارج از شمول در حقوق محاسباتی به‌شمار می‌آید و ازاین‌رو نظام حقوقی حاکم بر آن، پیچیده و قائم بر منطق ثانوی (در مقابل احکام اولیه) است. مهم‌ترین مسئله در فهم نظام حقوقی حاکم بر بودجۀ جنگ، کشف مبانی و منابع حاکم بر آن است. این تحقیق در تلاش است با رویکردی حقوقی، قوانین و مقررات مربوط به حوزۀ بودجۀ جنگ (به‌ویژه در زمان جنگ ایران و عراق) را تحلیل و در نتیجه، مهم‌ترین مسائل نظام حقوقی حاکم بر آن را تبیین کند. دستاورد این تحقیق، صرف‌نظر از طرح موضوع جدیدی در رشتۀ حقوق مالیۀ عمومی، تبیین، بیان ضرورت‌ها، مبانی و راهکارهای اصلاح نظام حقوقی حاکم بر بودجۀ جنگ است. https://jplsq.ut.ac.ir/article_59474_bc6572a3472608178b674549e4b0e957.pdf
