According to the theory of Thomas Aquinas, the consideration of a religious government under the rule of a divine law is an accepted module. He hypothesizes two main pillars: The government as a symbol of political authority, ruled by the King and the religious affairs that are ruled under the command of the Church. King, as a symbol of political authority, has the duty to pave the way for people to move toward a prosper eternal life reaching God. Although, he knows the political and religious institutions as two relatively independent phenomena, he emphasizes on the adherence of the Political Institution to its religious counterpart. This is the most challenging part of the Thomism's school. This paper shows that by considering the macro approaches of Thomism philosophy, such as ontology, epistemology, anthropology, it is possible to achieve the rule of a law and a State with religious beliefs under the issues of Public Law. <strong>    </strong>حکومت یک ضرورت طبیعی، شرعی و قانونی است. ازاین‌رو در مفروض توماس آکوئیناس توجه به یک دولت دینی تحت حاکمیت قانون الهی، مدلی مقبول است. فرضیّۀ او چنین است که نماد اقتدار سیاسی (حکومت) در اختیار شخص پادشاه و اقتدار دینی در اختیار کلیسا قرار دارد. پادشاه به‌عنوان نماد اقتدار سیاسی وظیفه دارد با تأمین سعادت دنیوی مقدمات لازم را برای رسیدن به سعادت اخروی که همان رسیدن به خداست، فراهم سازد. وی همچنین در عین توجه به استقلال نسبی نهاد سیاسی و دینی از هم، تبعیت نهاد سیاسی از نهاد دینی را تأکید می‌کند. همین موضوع چالش‌برانگیزترین بخش مکتب تومیسم است. مقالۀ حاضر نشان داده که با بررسی رویکردهای کلان فلسفۀ تومیسم مانند هستی‌شناسی، معرفت‌شناسی و انسان‌شناسی می‌توان به حاکیمت قانون و دولتی با باورهای دینی در ذیل مباحث حقوق عمومی در این مکتب دست یافت. https://jplsq.ut.ac.ir/article_59476_5fae41fa5d91d19caf2768cc3af97ee2.pdf
