But international obligations prescribed in the Convention on the law of the sea for the safeguard and protection of the deep sea area environment should be interpreted in a way that covers other existing regulations in the customary international law. Although in the Convention on the law of the sea provisions is no hinder to extend the international customary law obligations on the States parties to the Convention, but branches of International Tribunal for the Law of the Sea are reluctant to extend to the law of the sea. The approach of Seabed Disputes Chamber of International Tribunal for the Law of the Sea in 2011 advisory opinion indicate the responsibility of the Member State in protection and protections of the sea environment are limited solely to the provisions of the Convention on the Law of sea and its Executive agreements And the doctrines of customary international law do not work directly in this area. This contradictory approach of Seabed Disputes  مقررات کنوانسیون دربرگیرندۀ اسباب و ابزار لازم برای حفاظت و حمایت از محیط زیست منطقۀ اعماق دریاهاست. لیکن تعهدات بین‌المللی مقرر در کنوانسیون برای حفاظت و حمایت از محیط زیست منطقۀ اعماق دریاها باید به‌نحوی تفسیر شود که دیگر مقررات قابل‌ اجرای موجود در حقوق بین‌الملل عرفی را نیز در برگیرد. اگرچه در مقررات کنوانسیون برای تسری تعهدات حقوق بین‌الملل عرفی بر دولت‌های عضو کنوانسیون منعی وجود ندارد، در عمل مشاهده شده است که زیرمجموعه‌های دیوان بین‌المللی حقوق دریاها تمایلی به تسری تعهدات مصرح در آموزه‌های حقوق بین‌الملل عرفی در حوزۀ مسئولیت جبران خسارت به محیط زیست منطقۀ اعماق دریاها ندارند. رویکرد شعبۀ حل‌اختلاف بستر دریاها در نظریۀ مشورتی مورد تقاضای مقام دریاها نشان می‌دهد که مسئولیت دولت عضو کنوانسیون در حفاظت و حمایت از محیط زیست منطقۀ اعماق دریاها صرفاً محدود به مقررات کنوانسیون و موافقت‌نامۀ اجرایی آن است و آموزه‌های حقوق بین‌الملل عرفی به‌طور مستقیم در این حوزه کارایی ندارند. این رویکرد متناقض شعبۀ حل‌اختلاف با آموزه‌های حقوق بین‌الملل عرفی موجب شده است که دستاوردهای نظریۀ مشورتی وی نسبت به دولت‌های غیرعضو کنوانسیون کاربرد نداشته باشد. https://jplsq.ut.ac.ir/article_68753_971b2570d69f0ebb69ffe97b34b26d21.pdf
