By the end of the Cold War and after the1990s, a new approach to the concept of the right to self-determination emerged, which, by reconciling the right to self-determination and the principles of international law, including the principle of territorial integrity, could provide a solution to the issue of minority conflict. In the new approach to self-determination, the right of people to form a government turned to the right to organize the State by the people and the minorities. In this approach, the right to self-determination is used as the basis for the establishment of democracy and development of human rights as well as guarantee the rights of minorities. The precise explanation of this approach by using the legal analysis of related documents and their impact on the minorities' issue is the main purpose of this article. از پایان استعمارزدایی به این‌سو، طرح درخواست‌های جدایی‌طلبانه در پرتو حق تعیین سرنوشت از سوی اقلیت‌ها و واکنش خشونت‌بار دولت‌ها به آن، که با نقض گستردۀ حقوق بشر و تهدید صلح و امنیت بین‌المللی همراه بود، به‌عنوان مسئله‌ای مهم، در حقوق بین‌الملل مطرح بوده است. با پایان جنگ سرد و پس از تحولات دهه‌ی ۱۹۹۰، رویکرد‏ جدیدی درباره‌ مفهوم حق تعیین سرنوشت پدیدار شد که توانست با برقراری سازش میان حق تعیین سرنوشت و اصول حقوق بین‏الملل ازجمله اصل یکپارچگی سرزمینی، راه‌حلی برای مسئله‌ منازعات اقلیت‏ها ارائه دهد. در این رویکرد جدید، حق تعیین سرنوشت از حق تشکیل دولت، به حقِ سازمان‌دهیِ دولت به‏وسیله مردم و اقلیت‌ها جهت‌گیری داشته است. در این رویکرد، از حق تعیین سرنوشت به‌عنوان مبنا و پشتوانه‌ای برای استقرار دموکراسی و توسعۀ حقوق بشر و همچنین تضمین حقوق اقلیت‌ها استفاده می‌شود. تبیین دقیق این رویکرد، با بهره‌گیری از تحلیل حقوقی اسناد و مدارک مربوط، و بررسی تأثیر آن در حل‌وفصل مسئلۀ اقلیت‌ها هدف اصلی این مقاله بوده است. https://jplsq.ut.ac.ir/article_72862_3cb3d8339a5ac906bd1fee02e726460c.pdf
