Persistence of this problem in Iran, is partly due to defect of laws and regulations and partly due to the poor performance of them by governmental organs. Nevertheless, the Iranian judicial institutions, as the last resort for supervision on the enforcement of laws and regulations, can play a key role in the fight against air pollution, especially if the available strengths and opportunities are appropriately used in this fight. In this article, we will, referring to Iran's laws and regulations and in an analytical way, explain these strengths and opportunities in the hope that: 1. negligence of these strengths by judicial institutions, and their doubts about the use of them in the fight against air pollution would be resolved, and 2. awareness of available opportunities and use of them by individuals and institutions involved in air pollution lawsuits would be increased. به‌رغم گذشت ده‌ها سال از وضع قوانین و مقررات مرتبط با آلودگی هوا در ایران که اولین نمونۀ جامع آن، آیین‌نامۀ جلوگیری از آلودگی هوا مصوب 1354 و آخرین نمونۀ آن قانون هوای پاک مصوب 1396 است، معضل آلودگی هوا در ایران همچنان جدی است. بقای معضل آلودگی هوا در ایران، تا حدودی ناشی از نقص قوانین و مقررات و تا حدودی ناشی از عملکرد ضعیف نهادهای حکومتی در اجرای صحیح این قوانین و مقررات است. با وجود این، مراجع قضایی ایران به‌عنوان آخرین ملجأ نظارت بر اجرای قوانین و مقررات، می‌توانند نقشی اساسی در مبارزه با آلودگی هوا داشته باشند، به‌ویژه اگر در این مسیر از نقاط قوت و فرصت‌های موجود به‌نحو شایسته استفاده شود. در این نوشتار با استناد به قوانین و مقررات ایران و به شیوه‌ای توصیفی‌ـ‌تحلیلی، به معرفی این نقاط قوت و فرصت‌ها می‌پردازیم با این امید که: 1. غفلت مراجع قضایی ایران نسبت به این نقاط قوت، و تردیدشان در بهره‌مندی از آنها در مبارزه با آلودگی هوا، برطرف شود، و 2. آگاهی اشخاص و نهادهای مؤثر در طرح دعاوی مرتبط با آلودگی هوا، از فرصت‌های موجود افزایش یافته و بهره‌مندی آنها از این فرصت‌ها ارتقا یابد. https://jplsq.ut.ac.ir/article_75609_8f3174e4071b3c496622057ad909fa7d.pdf
