Biotechnology research companies have begun a new era in overcoming the disease by using genetic modification techniques. The findings of the present study, with a descriptive-analytical method, indicate that the COVID-19 vaccine based on genetic modification technology faces two main challenges. First, the relatively strict regulatory approach to genetically modified organisms that exists to protect the environment and human health; compliance with these regulatory requirements may make the evaluation process for the production of the vaccine a lengthy one. Second, companies active in this field seek legal protection for their intellectual property. Critics of intellectual property protection, however, believe that this type of protection of the COVID vaccine could potentially affect its accessibility and cost-effectiveness. In the legal system of the European Union and the United States, special legal measures have been adopted to address the above challenges. However, due to the emergency situation caused by the spread of the disease in the Iranian legal system, we still face Legal vacuum. شیوع بیماری کووید-19 در حال حاضر به بزرگ‌ترین بحران بهداشتی در سراسر جهان مبدل شده است. شرکت‌های تحقیقاتی فعال در حوزة زیست‌فناوری با بهره‌گیری از فنون اصلاح ژنتیک عصر جدیدی را در مبارزه با این بیماری آغاز کرده‌اند. یافته‌های جستار حاضر که به روش توصیفی-تحلیلی صورت گرفته، حاکی از این است که واکسن کووید-19 مبتنی بر فناوری اصلاح ژنتیک با دو چالش اساسی روبه‌روست: اول، رویکرد نسبتاً سختگیرانة مقررات در زمینة ارگانیسم‌های اصلاح‌شدة ژنتیک که در راستای حمایت از محیط زیست و سلامتی انسان وجود دارد و ممکن است رعایت این الزامات، فرایند تولید واکسن را با روند طولانی ارزیابی مواجه سازد؛ دوم، شرکت‌های فعال در این حوزه خواهان حمایت قانونی از دستاوردهای فکری خود هستند؛ حال آنکه منتقدان حمایت نظام مالکیت فکری بر این باورند که این نوع حمایت از واکسن کووید-19 به‌طور بالقوه می‌تواند قابلیت دسترسی و مقرون به صرفه بودن را تحت تأثیر قرار دهد. در نظام حقوقی اتحادیة اروپا و آمریکا برای برون‌رفت از چالش‌های مذکور تدابیر حقوقی خاصی مقرر شده است. حال آنکه نظر به وضعیت اضطراری ناشی از شیوع بیماری در نظام حقوقی ایران همچنان با خلأهای قانونی مواجهیم. https://jplsq.ut.ac.ir/article_87675_bb95ae1b886d7b4ee8ca571493971a73.pdf
