In such a situation, the need to address the concept of national security, which became a universal concept, was an essential step from the perspective of international law. The International Court of Justice (ICJ) began the process with three judgments issued in the Nicaragua case in 1986, and the Nuclear Weapons case in 1996, and the Oil Platforms case in 2003, which introduced national security concepts such as "fundamental interests, vital interests, and emergencies" into the international law literature. The first manifestations of this practice appeared in international human rights law and then international  disarmament law in the form of treaty terms. By analyzing the above-mentioned views, practices and sources, this paper will examine the formation of a "national security regime" in international law. A coherent and basic regime of specific rules and norms on national security, which is developing. از دهۀ80 میلادی در نتیجة بروز تهدیدات مرکب و درهم‌آمیختگی بیش‌ازپیش مسائل داخلی و خارجی مفهوم «امنیت ملی» در ادبیات بین‌المللی رواج پیدا کرد. در چنین وضعیتی لزوم پرداختن به مفهوم امنیت ملی که به مفهومی جهان‌شمول مبدل شده بود، از منظر حقوق بین‌الملل اقدامی اصولی بود. دیوان بین‌المللی دادگستری با سه رأی نیکاراگوئه 1986، سکوهای نفتی 2003 و رأی مشورتی 1996 با وارد ساختن مفاهیم امنیت ملی چون «منافع اساسی، منافع حیاتی و شرایط حاد و اضطراری» در ادبیات حقوق بین‌الملل، آغازگر این روند شد. اولین نمودهای این رویه در نظام حقوق بین‌المللی بشر و سپس حقوق خلع سلاح در قالب برخی شروط معاهده‌ای ظهور پیدا کرد. با تحلیل آرای مذکور، دیگر رویه‌ها و منابع، روند شکل‌گیری «رژیم امنیت ملی» در حقوق بین‌الملل بررسی شد. رژیمی منسجم و ابتدایی از مقررات و هنجارهای مشخص که شکل‌دهندة رژیم حقوقی امنیت ملی است؛ چنین رژیمی در حال توسعه است. https://jplsq.ut.ac.ir/article_93388_3239585661925ddfa8be0982e1d405c4.pdf
