The principle of diplomatic immunity enables diplomats to be protected from legal prosecution for violations of the laws of the host state. Granting extensive immunity to diplomats may sometimes seem to conflict with the fundamental right to seek justice for individuals whose rights have been overlooked by diplomats. Therefore, this article aims to address questions related to existing solutions regarding diplomatic crimes, avoiding instances of diplomatic abuse, ensuring the rights of victims, and the challenges ahead. The research methodology in this study is based on an explanatory-analytical approach. The results indicate that to preserve individuals' right to seek justice and reduce crimes committed by diplomats through their common abuses of diplomatic privileges and immunities, there is a need to amend the Vienna Convention and the laws of  «مصونیت دیپلماتیک» به‌عنوان یکی از مفاهیم حقوق بین‌الملل، در حفظ روابط دیپلماتیک کشورها و حقوق و آزادی‌ دیپلمات‌ها تأثیر بسزایی دارد. اصل مصونیت دیپلماتیک، دیپلمات‌ها را قادر ساخته است تا از پیگرد قانونی در برابر نقض قوانین دولت پذیرنده مصون شوند. اعطای مصونیت گسترده به دیپلمات‌ها در مواردی ممکن است با حق اساسی دادخواهی افرادی که حقوقشان از سوی دیپلمات‌ها نادیده گرفته‌ شده است، در تضاد به‌نظر برسد، ازاین‌رو در این مقاله سعی بر آن است تا به پرسش‌های مربوط به راه‌حل‌های موجود نسبت به جرائم دیپلماتیک و اجتناب از موارد مربوط به سوءاستفادة دیپلماتیکی و تضمین حقوق قربانی و نیز چالش‌های پیشرو پاسخ داده شود. روش تحقیق در این پژوهش مبتنی بر روش تبیینی-تحلیلی است. نتیجة پژوهش بیانگر آن است که برای حفظ حق دادخواهی افراد در جهت کاهش جرائم ارتکابی دیپلمات‌ها با سوءاستفاده‌های رایج آنها از مزایا و مصونیت‌های دیپلماتیک، نیاز به اصلاح کنوانسیون وین و قوانین کشورها در زمینة حقوق دیپلماتیک و ایجاد یک دیوان بین‌المللی دیپلماتیک به‌منظور بهبود عملکرد دیپلمات‌ها و اعادة وضع قربانی جرم به حال سابق بوده است. https://jplsq.ut.ac.ir/article_95355_f63266487b06bb04aeeac47d271efbcd.pdf
