This article uses descriptive-analytical methods to study the efforts to explain and prohibit terrorism in the international legal system. The findings of this study show that a number of courts, namely the Special Court for Lebanon, England Court of Appeal, and the Court of Cassation of France put forward controversial arguments to recognize the crime of international terrorism in peacetime as a customary law crime. They have even tried to link it to the basics of jus cogens. It should, however, be noted that the reasoning that erga omnes obligations of states to prohibit terrorism concerning certain terrorist acts - the actions of Daesh - cannot be baseless; because these terrorist attacks are an unprecedented threat to international peace and security, and they are indeed a threat to the values respected by the international community. However, the study of a set of counter-terrorism legal measures at the national, regional, and international levels does not reflect the legal consensus of states -the international community as a whole- on the definition of terrorism and its examples. مسئولیت مدنی اشخاص در دانش حقوق یکی از مسائل پیچیدة این دانش است که پیوسته مباحث زیادی را پیرامون خود داشته است. یکی از این مباحث، قلمروشناسی مسئولیت مدنی حکومت در برابر مسئولیت مدنی اشخاص خصوصی است. با درک چنین اهمیتی بوده است که در این نوشتار به این موضوع پرداخته شده است و به این پرسش اساسی پاسخ داده شده است: مرزهای مفهوم‌شناختیِ مسئولیت مدنی حکومت در برابر مسئولیت مدنی اشخاص خصوصی چیست؟ در پاسخ به این پرسش، تحقیق حاضر با استفاده از روش تحقیق توصیفی -تحلیلی به این نتایج دست یافته است: نخست اینکه دلایل منشأشناختی، تاریخی، فلسفی در این خصوص نقش اساسی دارند؛ ثانیاً نقطة آغازین مسئولیت مدنی حکومت و مسئولیت مدنی اشخاص خصوصی الزاماً یکسان نیست؛ ثالثاً در مقام شناخت مسئولیت مدنی حکومت، «عمل حاکمیت» و «عمل اقتداری» محوری‌ترین مؤلفه در ترسیم راه این‌گونه مسئولیت به‌شمار می‌آیند.  https://jplsq.ut.ac.ir/article_99302_8fb622a9e243f5cf2a49a06142c08c35.pdf
