Abstract

The existence of a specific model of legislation in each legal system has helped to draw the relationships of legal institutions, and it has answered many of the problems of that legal system. The most important elements of any legislative model are three things; The binding basis of the legal rule, the sources of the legal rule and legislative institutions. The purpose of writing this article is to present the ideal legislative model in the system of the Islamic Republic of Iran. The method of collecting information in this documentary-written, the method of research is rational and narrative and the method of processing information is descriptive-analytical. In this article, it has been proven that, contrary to the initial idea, the basis of binding force of legal rules in the legal system of the Islamic Republic of Iran is not the will of the God, but the will of the institution of the absolute authority of the jurist. In such a system, the will of God is the only basis of political legitimacy, not the basis of legal rule, and it should not be confused between legal philosophy and political philosophy. Also, the legal sources in this legal system are Sharia law, statute law, judicial precedents, custom and legal doctrine. Legislative institutions are also classified into two categories; Some of them derive their legitimacy of legislation directly from the institution of the authority of the jurist, and others, derive their authority from the theory of delegation.
