Abstract
The idea of limiting power of the state has a history and has undergone changes throughout history. In order to understand the idea of limiting power of the state in the contemporary period and the idea of constitutionalism, it is necessary to know the process of evolution of this concept. Deposit as a specific contract in jurisprudence, in public law, has a different concept and is a basis for limiting the power of state, which appears a lot in the Qajar era and in the written works of that time. The concept of deposit as a basis for limiting power of government is based on the foundation that was established in the Safavid era, and in works of scholars of Safavid era, .Gradually, as the jurisprudential aspect of this concept faded, its political aspect was added, and deposit as a basic theory in governance turned into a concept to regulate relationship between people and the king. This article, with a descriptive-analytical method and using library sources, aims to investigate the concept of deposit and its origin and evolution as a basis for limiting the power of the state in the Qajar period and finding its roots in the Safavid era.
