Abstract

With increasing awareness of the dire conditions of the environment and the importance of sustainable development, governments adopted a wide range of measures in order to protect health, safety and the environment. HSE measures generally seek to protect people against HSE risks and changing production and consumption patterns. This issue, along with the emergence of the Covid-19 virus, which was first discovered in late 2019 in China and has since become a global epidemic, has made the world of humanity face unprecedented challenges. Covid-19, which was a health crisis in the first place, not only affected the daily life of people, but also affected the global economy and trade relations between countries. This article tries to investigate whether, despite the World Trade Organization and free trade rules, in the context of this virus epidemic, countries can impose legal restrictions in their trade relations by resorting to HSE? Examining the agreements of the World Trade Organization indicates that this organization has considered the possibility for its members to prioritize the health and safety of their citizens in special and emergency situations and temporarily ignore the fundamental principles of the organization.
