Abstract

The state of necessity as one of the circumstances precluding the wrongfulness of an unlawful act is a solution to situations where safeguarding the essential interests of the state or the international community requires the violation of primary obligations. This essay investigates the plea of necessity in the area of environmental law from the perspective of international law and Imami jurisprudence. The main problem of invoking necessity in this area is the uncertainty of damage in environmental cases, which is incompatible with the requirement of imminent peril. Contrary to international law, legal topics related to necessity have not received much attention from Islamic scholars; However, by referring to Maxims of Islamic law, using the method of a comparative legal study of verses, traditions, and opinions of Islamic jurists to the rules of international law, it is possible to codify the fundamental rules of the state of necessity in Imami jurisprudence. By investigating international documents and jurisprudential sources, it can be concluded that the state of necessity in international environmental law has an exceptional nature in both legal systems and compensation for the damage is accepted and inevitable.
