Abstract

In the conventional approach in Iran's constitutional law, the constitution is a definable abstract concept or a legal document. This view requires the acceptance of civil society and the state based on a mechanical approach. This is despite the fact that in Hegel's absolute idealism, the constitution is presented as the founding principles of the organic state, which is determined in the context of moralistic life. moralistic life in Hegel's view is not a mechanical phenomenon, but rather a dynamic process through which an unfinished unity is more and more determined, interwoven and composed. The organic process is from unity to heterogeneity and from heterogeneity to unity in heterogeneity, which determines and organizes the multiple institutions of civil society in the form of the state and brings it to unity. The organic state in Hegel's intellectual system is not considered as a mere political institution or governing structure, but as an evolved organism and as the last stage of the soul's evolution in history; The process of organic growth of the state transforms the constitution as its founding principles from an abstract concept to a concrete and historical research idea.
