Abstract
Kelsen's pure theory of law is considered the most complete expression of legal positivist philosophy. Kelsen calls it "pure" because removes all non-legal elements by providing a hierarchical legal structure. However, the inability to encompass the fundamental norm and the assumption of its validity expose the theory to criticisms. Part of the criticisms directed at this theory stem from neglecting the objective of it (understanding legal systems). By taking into account the goal of the theory, assuming the validity of the fundamental norm can be justified.In this research, based on a descriptive and analytical method, it is suggested that the claim of the "purity" of this legal theory should be reconsidered and replaced with a more appropriate title that reflects the hierarchical structure. Furthermore, a plan has been presented for legislation and interpretation based on this theory. Based on this plan, firstly, legislation must follow a chain-like and hierarchical structure to reach one of the constitutional principles or the fundamental norm. Secondly, to avoid potential deadlocks that may arise from excluding non-legal elements in legislation, the idea of the necessity of a soft constitution has been proposed. Finally, the requirements for legal interpretation and the establishment of judicial precedent have been explained.
