Abstract
Reason, as one of the most obvious features that separates humans from animals, has always had a special place in his life and has been placed as a source in Islamic international law. Martens clause is also accepted as a customary rule in international humanitarian law in the preamble of the Hague Peace Conventions of 1899 and 1907. The present study tries to investigate the place of reason in Islamic international law and the Martens clause in humanitarian international law with a descriptive-analytical method. Even though reason has been introduced as one of the sources of deriving Sharia rulings, the type of its application is disputed (controversial debates between the school of natural law and the school of positivism). Martens' quote has also taken a step towards identifying human principles that are based on the call of the general conscience of mankind. The results of the research indicate that the two concepts of reason and Martens' clause are in the same position in terms of reference in international law and are considered as customary rules that are cited both in Islam and in international humanitarian law.
