Abstract

Ad hoc international criminal tribunals(former Yugoslavia and Rwanda) in criminal proceedings, outweigh domestic courts in their territories of jurisdiction. Necessity for these states to abide by rules of the statute and procedures of the said courts on the one hand and the need to strengthen judicial and legal system of these two territories based on completion strategy of the above mentionsd international courts, on the other hand,give a local and regional face to the administration of justice in these post conflict territories. It highlights coherent national reconciliation plans for capacity building in these dedicated courts. Accordingly, the mentioned courts, with exploited international organizations and internal proposals of foregoing countries in coherent programs(workshops, training of police, judicial, and law enforcement forces in these countries and…) have taken important systems and realization of transitional justice. steps to strengthen national. However, these international criminal courts have exploited capacity building as a mechanism of the transitional justice process with challenges such as prejudice of judges and prosecutors and … in this regard countries have faced, but the effectiveness of the capacity building programs in meeting the criteria and elements of the rule of law within these territories are undeniable.
