Abstract

Since the 1980s, as a result of the emergence of complex threats and the increasingly intertwined internal and external issues, the concept of national security has emerged. In such a situation, the need to address the concept of national security, which had become a universal concept, was a principled step from the perspective of international law. The International Court of Justice (ICJ) began the process with three rulings in Nicaragua in 1986, oil rigs in 2003, and the Advisory Council in 1996, introducing national security concepts such as "fundamental interests, vital interests, and emergencies" into the international law literature. The first manifestations of this practice appeared in the system of international human rights and then the right to disarmament in the form of some treaty conditions. By analyzing the above-mentioned views, some procedures and sources, the process of forming a "national security regime" in international law was examined. A coherent and basic regime of specific rules and norms that form the legal regime of national security. Such a regime is developing.
