Abstract

Free trade zones, which have been created with the aim of facilitating trade activities, especially in underdeveloped countries, have also emerged and expanded in the Iranian legal system. This study focuses on evaluating the management and legal system of free zones from the perspective of the relationship between the governing body of these zones and the executive bodies active in their territory; This article shows that the laws governing the administration of free zones have not been able to provide a suitable model for coordination between responsible organizations in free zones. The mechanism embedded in the laws (Article 65 (A) of the Law on Permanent Provisions of the Country Development Plans) faces challenges due to non-compliance with the principles of public administration and administrative law. According to this, besides to the need to repeal the above provision, it is necessary to stipulate that exercising the powers of the responsible organizations in free zones does not negate the exercise of legal powers of the relevant executive bodies. Also, besides to limiting the powers of the above-mentioned organizations to commercial-industrial affairs, to establish executive coordination between the executive bodies and the responsible organization of the regions, forming a council composed of the director of that organization and the highest officials executive bodies is recommended.
