The Status of the Principle of Non-Intervention in the Internal Affairs ‎of States in the Legal System of Iran

Abstract
Laws and regulations represent an important aspect of the fundamental approaches of a government towards various international issues. Particularly, depending on the subject, a law or regulation in a country may acquire an international dimension, or the law or regulation may be established to determine the main strategies of the government in dealing with international topics. This article aims to explore the approach of the Islamic Republic of Iran to the principle of non-intervention, examining the position of this principle in Iranian domestic law. Several principles of the Constitution of the Islamic Republic of Iran, especially Articles 152 and 154, are directly related to the concept of "non-intervention" in international law. The phrases used in these principles, such as "denial of domination and subjugation," "complete abstention from interfering in the internal affairs of other nations," and "support for the just struggle of the oppressed against the oppressors," indicate the proactive approach of the Constitution towards the issue of intervention. Although this may be accompanied by ambiguities in some cases, it outlines an approach that, while being independent, is aligned with the principles and rules of international law. Iranian domestic law has not taken a clear approach in enacting ordinary laws related to the principle of non-intervention, and in most cases, legislation in this area has been reactive.
