Abstract

While most of the conducted research focused on the issue of humanitarian aid from an ethical and not mandatory approach; The current research has dealt with the task of providing humanitarian aid from the perspective of Islamic jurisprudence with a new approach. In the international human rights system, only with the extensive interpretation of these rights and adopting a positive approach towards it, the only obligation to accept humanitarian aid has been proven. With a different perspective, this research seeks to investigate the evidence of the duty to provide humanitarian aid from the perspective of Islamic jurisprudence and believes that the religion of Islam, having progressive principles in relation to the international human rights system, provides a positive approach to humanitarian aid. In this regard, the pre-jurisprudential evidences of human dignity and justice and the internal jurisprudential evidences of the obligation to preserve life of human being and the principle of compilation of hearts in the matter of zakat, better prove the obligation to provide humanitarian aid to all people exposed to natural and unnatural disasters, especially to non-Muslims.
