Abstract

Regulation in modern governance is a challenging emerging phenomenon and there are noteworthy gaps in its principles. With the transition from the paradigm of big government and small government, a new form of governance has been proposed under the title of regulatory government. In this paradigm, regulatory authorities have been set up with the aim of achieving public benefit and have started to regulate, supervise and implement with reasonable means in the law. For this reason, the regulated persons are directly affected by the decisions of the regulatory authorities, and the government and the people are indirectly affected. Now, the question of the research is that if the regulatory authorities, due to not complying with their legal duties, cause harm to their related and affected persons, can they be held legally responsible? Or because of the nature of their sovereignty in affairs, they are exempt from responsibility? The reasons, findings and documents presented in the current research indicate that there should be such a responsibility for the regulatory institutions and oblige them to compensate for the damage. The solutions to compensate for the damages caused by the actions of such regulatory authorities can also be seen in this article.
