Abstract

Environmental protection is considered as one of the most important international issues of today. To this end, various international attempts have been made including the conclusion of different environmental treaties, the efforts of international and regional trade organizations such as the NAFTA, the European Union and even the World Trade Organization to incorporate environmental protection regulations into the free trade regulations. Moreover, the case law of the international institutes such as the International Court of Justice, international arbitral tribunals and quasi international judicial forums such as the WTO panels as well as the internal courts have played an important role in this regard. The question is to what extent have international and domestic jurisprudence been effective in promoting environmental protection? Using descriptive and analytical methods the main objective of this article is to identify the status and importance of environmental regulations in international trade relations through the jurisprudence of international courts and arbitrations, quasi-judicial forums as well as national courts.
