Legal studies that aim to explain the transformation of the state often emphasize the political elements that give rise to the modern state. They highlight the fundamental difference between such a state and other forms of political power experienced throughout history, noting that this mechanism primarily seeks to safeguard political freedom through new political institutions such as the separation of powers, parliament, elections, and so on. This focus frequently ignores the economic origins of this social transformation, as well as the economic outcomes of this political system—such as economic efficiency, growth, development, welfare, and similar concepts—being less emphasized or even overlooked. This is so, despite the fact that the genealogy of the modern state suggests that if the role of economic elements in establishing this new order is not greater than that of political elements, it is certainly not less; in other words, the modern state is more an institution with an economic nature than one with a political origin. On the other hand, this neglect of the economic origins of the modern state has posed challenges for the idea of an Islamic state, which seeks to establish an Islamic government as a political system implementing Sharia while also recognizing the undeniable impact of the requirements of national states, as the current status of contemporary Islamic states, and benefiting from modern institutions.
