تأملی بر مفهوم و کارکرد مشارکت اداری

چکیده
در نظام‌های اداری پویا، مشارکت شهروندان در تصمیم‌گیری‌ها با روش‌های مختلف صورت می‌گیرد که از آن تحت عنوان «دموکراسی اداری» یا «دموکراسی مشارکتی» یاد می‌شود، به‌نحوی که میزان تحقق حق حاکمیت مؤثر شهروندان، با سطح مشارکت آنان در ادارة امور عمومی سنجیده می‌شود. این پژوهش که با روش توصیفی ـ تحلیلی و با استفاده از منابع کتابخانه‌ای انجام شده است، در راستای معرفی الگوهای مختلف مشارکت شهروندان در حوزة فعالیت‌های نظام اداری و ضمانت‌های اجرایی آن بوده و در پی پاسخ به این سؤال است که وضعیت مشارکت شهروندان در تصمیمات اداری کشور ما چگونه قابل ارزیابی است؛ به‌عبارت دیگر دموکراسی اداری در کشور چه وضعیتی دارد و ظرفیت‌های حقوقی موجود از چه قرار است؟ یافته‌های این پژوهش نشان می‌دهد مشارکت اداری در مفهوم خاص خود در خصوص تصمیمات اداری عام‌الشمول و غیرشخصی قابل اعمال است و می‌تواند به پویایی و کارامدی بیشتر نظام اداری منتهی شود. در نظام حقوقی ایران نیز ظرفیت قانونی مناسبی برای نقش‌آفرینی مردم به‌عنوان دارندگان اصلی قدرت در عرصه‌های مختلف وجود داشته و مشارکت عامه مردم در امور مختلف به رسمیت شناخته شده است، لکن در عرصة عملی فاصلة زیادی تا وضعیت مطلوب وجود دارد.

A Reflection on the Concept and Function of Administrative Participation

چکیده English

In dynamic administrative systems, citizens participate in decision-making through various methods, referred to as “administrative democracy” or “participatory democracy”, whereby the realization of citizens’ effective sovereignty is measured by their level of involvement in the management of public affairs. This study, conducted using a descriptive-analytical approach and library research, aims to introduce different models of citizen participation in administrative activities and their enforcement guarantees. It also seeks to answer the question: How can citizen participation in administrative decisions in our country be evaluated? In other words, what is the current state of administrative democracy in the country, and what legal capacities exist to support it? The findings indicate that administrative participation, in its specific sense, can be applied to general and non-personal administrative decisions and can lead to greater dynamism and efficiency in the administrative system. In Iran’s legal system, there are also adequate legal capacities for citizens to play an active role as the primary holders of power in various domains, and public participation in different matters is formally recognized. However, in practice, a significant gap remains between the current situation and the desired level of participation.
