چکیده

در نظام‌های اداری پویا، مشارکت شهروندان در تصمیم‌گیری‌ها با روش‌های مختلف صورت می‌گیرد که از آن تحت عنوان «دموکراسی اداری» یا «دموکراسی مشارکتی» یاد می‌شود، به‌نحوی که میزان تحقق حق حاکمیت مؤثر شهروندان، با سطح مشارکت آنان در ادارة امور عمومی سنجیده می‌شود. این پژوهش که با روش توصیفی ـ تحلیلی و با استفاده از منابع کتابخانه‌ای انجام شده است، در راستای معرفی الگوهای مختلف مشارکت شهروندان در حوزة فعالیت‌های نظام اداری و ضمانت‌های اجرایی آن بوده و در پی پاسخ به این سؤال است که وضعیت مشارکت شهروندان در تصمیمات اداری کشور ما چگونه قابل ارزیابی است؛ به‌عبارت دیگر دموکراسی اداری در کشور چه وضعیتی دارد و ظرفیت‌های حقوقی موجود از چه قرار است؟ یافته‌های این پژوهش نشان می‌دهد مشارکت اداری در مفهوم خاص خود در خصوص تصمیمات اداری عام‌الشمول و غیرشخصی قابل اعمال است و می‌تواند به پویایی و کارامدی بیشتر نظام اداری منتهی شود. در نظام حقوقی ایران نیز ظرفیت قانونی مناسبی برای نقش‌آفرینی مردم به‌عنوان دارندگان اصلی قدرت در عرصه‌های مختلف وجود داشته و مشارکت عامه مردم در امور مختلف به رسمیت شناخته شده است، لکن در عرصة عملی فاصلة زیادی تا وضعیت مطلوب وجود دارد.

چکیده [English]

In dynamic administrative systems, citizen participation in decision-making takes place in different ways, which is referred to as "administrative democracy" or "participatory democracy" in such a way that the degree of effective Sovereignty of the people are measured by their level of participation in the administration of public affairs. This research, which was carried out with the descriptive-analytical method and using library resources, aims to introduce different patterns of citizen participation in the field of administrative system activities and its executive guarantees, and seeks to answer the question that the state of citizen participation how can it be evaluated in the administrative decisions of our country? In other words, what is the state of administrative democracy in the country and what are the existing legal capacities? The findings of this research show that administrative participation in its special sense can be applied to general and impersonal administrative decisions and can lead to greater dynamism and efficiency of the administrative system. In Iran's legal system, there is a suitable legal capacity for the role of the people as the main holders of power in various fields, and the participation of the public in various matters is recognized, but in the practical field, there is a long distance from the desired situation.
