چکیده

قانون اساسی در رویکرد متعارف در حقوق اساسی ایران به عنوان یک مفهوم انتزاعی قابل تعریف و یا یک سند قانونی موضوعیت دارد. این تلقی مستلزم پذیرش جامعه ی مدنی و دولت مبتنی بر رویکرد مکانیکی است. این در حالی است که در ایدئالیسم مطلق هگل، قانون اساسی به مثابه ی اصول تاسیسی دولت ارگانیک مطرح می گردد که در بستر زندگانی اخلاق گرایانه متعین می شود. زندگانی اخلاق گرایانه در نظرگاه هگل یک پدیده ی مکانیکی نیست، بلکه فراگردی پویاست که وحدتی ناتمام از راه آن هر چه بیشتر متعین، درهم تافته و متشکل می گردد. سیر ارگانیک از وحدت به ناهمسانی و از ناهمسانی به وحدت در ناهمسانی است که نهادهای متکثر و متعدد جامعه ی مدنی را در صورت دولت متعین و متشکل کرده و به وحدت می رساند. دولت ارگانیک در نظام فکری هگل نه به عنوان یک نهاد سیاسی یا ساختار حاکمیتی صرف، بلکه به مثابه یک ارگانیسم تکامل یافته و به عنوان آخرین مرحله از تکامل روح در تاریخ مورد نظر است؛ فرآیند رشد ارگانیک دولت، قانون اساسی را به عنوان اصول تاسیسی آن، از یک مفهوم انتزاعی به یک ایده ی محقق تاریخی و انضمامی تبدیل می نماید.

چکیده [English]

In the conventional approach in Iran's constitutional law, the constitution is a definable abstract concept or a legal document. This view requires the acceptance of civil society and the state based on a mechanical approach. This is despite the fact that in Hegel's absolute idealism, the constitution is presented as the founding principles of the organic state, which is determined in the context of moralistic life. moralistic life in Hegel's view is not a mechanical phenomenon, but rather a dynamic process through which an unfinished unity is more and more determined, interwoven and composed. The organic process is from unity to heterogeneity and from heterogeneity to unity in heterogeneity, which determines and organizes the multiple institutions of civil society in the form of the state and brings it to unity. The organic state in Hegel's intellectual system is not considered as a mere political institution or governing structure, but as an evolved organism and as the last stage of the soul's evolution in history; The process of organic growth of the state transforms the constitution as its founding principles from an abstract concept to a concrete and historical research idea
