Kelsen’s Pure Theory of Law has been considered the most complete expression of positivist legal philosophy. Kelsen regards this theory as “pure” because, by presenting a hierarchical structure of law, it eliminates all non-legal elements from it. However, the inability to cover the basic norm (Grundnorm) and the assumption of its validity have exposed the theory to criticisms. Part of the criticisms directed at Kelsen’s Pure Theory of Law arises from neglecting the purpose of the theory, which is the understanding of legal systems. By taking the purpose of the theory into account, assuming the validity of the basic norm becomes justifiable. In this descriptive-analytical study, it is proposed that the claim of the theory’s purity should be reduced and replaced with a title more consistent with its hierarchical structure. Furthermore, after examining various dimensions of the theory, a plan for legislation and the interpretation of laws based on Kelsen’s Pure Theory of Law is presented, according to which: Legislation must follow a chain-like hierarchical structure leading ultimately to one of the constitutional principles or the basic norm. To overcome potential deadlocks that may arise from excluding non-legal elements in legislation, the idea of the necessity of a “soft constitution” is proposed. Finally, the requirements for legal interpretation and the establishment of judicial precedent are explained.
