چکیده
قانون اساسی بهعنوان مفهوم کلیدی حقوق عمومی و حقوق اساسی مفهومی بسیار پیچیده است. در حول این مفهوم و در نظریۀ حقوق اساسی مفاهیم متعددی شکل گرفته است. یکی از این مفاهیم فرهنگ اساسی است. فرهنگ اساسی منشعب از مفاهیمی مانند فرهنگ سیاسی و فرهنگ حقوقی است. با فهم فرهنگ اساسی میتوان قانون اساسی را بیشتر شناخت. فرهنگ اساسی تجسم فرهنگ حقوقی است و ارزشها و بنیانهای قانون اساسی را نشان میدهد. از طریق فرهنگ اساسی میتوان به این نکته پی برد که مردم یک کشور تا چه اندازه قانون اساسی بهعنوان سند بنیادین نظام حکومتی را مورد پذیرش قرار دادهاند. این مقاله با روش توصیفی- تحلیلی بهدنبال پاسخگویی به این پرسش است که فرهنگ اساسی به چه معناست و چه ویژگیها و کارکردی دارد. در این مقاله همچنین تأثیر این مفهوم در تصمیمات دادرس اساسی بررسی شده و اینکه بهعلت تفاوت در فرهنگ اساسی سنتهای متفاوتی در حقوق اساسی شکل گرفته است.

چکیده [English]
The constitution, as a key concept of public law and fundamental rights, is a very complex concept. Several concepts have been formed around this concept and in the theory of fundamental rights. One of these concepts is constitutional culture. Constitutional culture is derived from concepts such as political culture and legal culture. By understanding constitutional culture, one can better understand the constitution. Constitutional culture is the embodiment of legal culture and shows the values and foundations of the constitution. Through constitutional culture, one can understand the extent to which the people of a country have accepted the constitution as the fundamental document of the government system. This article seeks to answer the question of what constitutional culture means and what its characteristics and functions are through a descriptive-analytical method. This article also examines the impact of this concept on the decisions of the constitutional judge and that different traditions have been formed in constitutional law due to differences in constitutional culture.
