تحولات هنجارسازی در حقوق بین‌الملل فضا با نگاهی به قطعنامۀ 1992 اصول مربوط به بهره‌برداری از انرژی هسته‌ای در فضای ماورای جو

چکیده
هنجارسازی در حقوق بین­الملل فضا در شش دهۀ گذشته دستخوش تحولات شایان توجهی شده است. پس از نهایی شدن موافقتنامۀ ماه، رفته رفته این دیدگاه در بین حقوقدانان بین­المللی قوت ­گرفت که دیگر احتمال تهیه و تنظیم سند الزام­آوری در قالب معاهده در حقوق بین­الملل فضا وجود ندارد. به همین دلیل تمایل دولت­ها برای تدوین دستورالعمل­ها، قواعد رفتاری و قوانین ملی فضایی قوت گرفت. یکی دیگر از مصادیق این تغییر جهت هنجاری، تهیه و تنظیم قطعنامه­های سازمان ملل در خصوص مسائل مربوط به فضای ماورای جو است. یکی از مصادیق برجستۀ این دست اعلامیه­ها، اعلامیۀ اصولی مربوط به بهره­برداری از انرژی هسته­ای در فضای ماورای جو است که در سال 1992 به تصویب مجمع عمومی رسید. در این مقاله، سیر تحولات هنجاری حقوق بین­الملل فضا و گذر این بدنۀ هنجاری از حقوق سخت به حقوق نرم در آینۀ قطعنامۀ مذکور بررسی شده است.

چکیده English

Norm-making in International Law of Space has gone through quite significant shifts. After the conclusion of the Moon Agreement, It was commonly believed that the chances for the adoption of a hard-law document in the Law of Space re next to none. Thus, States began to embrace guidelines, codes of conduct and even national legislations regarding space in order to fill this normative void. Another manifestation of this shift is the adoption of space-related Resolutions in the United Nations. A prime example of such documents, adopted by the UN's General Assembly, is the 1992 Resolution on Principles Relevant to the Use of Nuclear Power Source in Outer Space. The article at hand endeavors to analyze the said normative shift and peruses the aforementioned resolution as a case-study.
