بررسی شرایط تعلیق حقوق بشر در زمان مخاصمات مسلحانه (مطالعۀ موردی: منازعۀ فلسطین ـ اسرائیل)

چکیده
مسئلۀ حقوق بشر و آزادی­های اساسی در طول قرون متمادی هسته و انگیزۀ اصلی مبارزه علیه ظلم و بی‌عدالتی را تشکیل داده است. هدف از این‌گونه تلاش­ها تأمین حداقل حقوقی برای افراد جامعه است. با این حال، برخلاف حقوق بشردوستانه که مختص زمان مخاصمات مسلحانه است، حقوق بشر در تمام وضعیت­ها اعم از جنگ و صلح لازم‌الاجراست. اما از آنجا که مخاصمات مسلحانه به‌نوعی تهدیدکنندۀ بقای دولت است، برخی از اسناد بین‌المللی و منطقه‌ای از جمله مادۀ 4 میثاق بین‌المللی حقوق بشر، مادۀ 15 کنوانسیون اروپایی حقوق بشر و مادۀ 27 کنوانسیون آمریکایی حقوق بشر به دول عضو اجازۀ تعلیق حقوق بشر را با رعایت ضوابطی داده‌اند. سؤالی که مطرح می‌شود این است که دولت­ها در صورت وقوع چنین مخاصماتی نمی‌توانند حقوق بشر را تعلیق کنند یا خیر؟ این تعلیق مطلق است یا منوط به شرایطی است؟ در صورت مشروط بودن آن، دولت­ها در چه شرایطی می­توانند در زمان چنین مخاصماتی قواعد حقوق بشر را تعلیق کنند؟ یا دولت­هایی که به تعلیق حقوق بشر پرداخته‌اند تا چه حد شرایط لازم را جهت استفاده از بند تعلیق رعایت کرده‌اند؟ مقالۀ حاضر می‌کوشد با تمرکز بر منازعۀ فلسطین ـ اسرائیل به پرسش‌های مذکور پاسخ دهد.

چکیده English

Human rights and fundamental freedoms have formed the main core of the struggle against injustices for centuries. The aim of these efforts is to provide individuals with basic rights. However, Contrary to Humanitarian Law that applies only in armed conflicts, Human Rights are indispensable at all times, in war and peace alike. But since armed conflicts are a threat to the survival of the State, Questions then arise: Can governments derogate from Human Rights in time of such conflicts? If so, is this suspension absolute or conditional? If conditional, under what circumstances can governments employ such measures? Ultimately, if a State chooses to apply the suspension Clause, to what extent is it in compliance with its conditions? This article attempts to answer the questions above with a focus on the Israeli-Palestinian conflict.
